In general, work consists of the following approximate quantities: 54 LF 12" WATERMAIN DUCTILE IRON PIPE, CLASS 52 5,974 LF 16" WATERMAIN DUCTILE IRON PIPE, CLASS 52 1,340 LF 20" WATERMAIN DUCTILE IRON PIPE, CLASS 52 423 LF 24" WATERMAIN DUCTILE IRON PIPE, CLASS 52 425 LF 30" STEEL CASING PIPE 6,260 LBS DUCTILE IRON FITTINGS 13,036 SY SY REMOVE BITUMINOUS STREET PAVEMENT 560 CY EXCAVATION COMMON - TRAIL OR SIDEWALK (EV) 8,839 CY EXCAVATION SUBGRADE (EV) 14,231 SY SUBGRADE PREPARATION 4,602 SY SUBGRADE PREPARATION - TRAIL 4,442 TON AGGREGATE BASE, CLASS 5 1,064 TON AGGREGATE BASE, CLASS 5 - TRAIL 438 SY 7-INCH-THICK CONCRETE DRIVEWAY (COMMERCIAL OR RESIDENTIAL) 676 TON TYPE SP 9.5 WEARING COURSE MIXTURE (2,C) 941 TON TYPE SP 9.5 WEARING COURSE MIXTURE (3,C) 1,568 TON TYPE SP 12.5 WEARING COURSE MIXTURE (3,C) The provisions of MINN. STAT. 16C.285 Responsible Contractor are imposed as a requirement of this contract. All bidders and persons or companies providing a response/submission to the Advertisement for Bids of the City of Woodbury shall comply with the provisions of the statute. The Owner reserves the right to retain the deposits of the 3 lowest Bidders for a period not to exceed 60 days after the date and time set for the Opening of Bids. No Bids may be withdrawn for a period of 60 days after the date and time set for the Opening of Bids. The Owner reserves the right to reject any and all Bids, to waive irregularities and informalities therein, and further reserves the right to award the Contract to the best interests of the Owner. Bid Security in the amount of 5 percent of the amount of the Bid must accompany each Bid in accordance with the Instructions to Bidders. The successful Bidder will be required to furnish a Construction Performance Bond, a Construction Payment Bond and a Warranty Bond, each for 100 percent of the Bid amount, as security for the faithful performance and the payment of all bills and obligations arising from the performance of the Work. The Project is being funded in whole or in part by the Minnesota 3M and State of Minnesota PFAS Settlement Agreement. As such, Contractor shall comply with all applicable State and Federal Laws, Rules, and Regulations. References to applicable laws, rules, and regulations have been included in the Bidding Documents. Bidder shall cooperate with the Owner to respond to any reasonable requests by the State of Minnesota within the scope of the grant agreements entered into between the State of Minnesota and the Owner for use of the 3M Settlement Funds for the Project including providing data, information, or reports or requests for meetings (onsite, offsite, in person, or remote). This Project is also being funded in whole or in part by the EPA Community Grants Program and administered by the U.S. Environmental Protection Agency (U.S. EPA). As such, Federal Davis Bacon prevailing wages apply to this project. Payment of wages, fringe benefits, and overtime rates that are most beneficial to the employees are required. As part of the funding source, the American Iron and Steel requirements, Build America, Buy America (BABA) requirements, EPA's Disadvantaged Business Enterprise (DBE) Program requirements, will also be included. For additional information regarding funding requirements, visit the U.S. EPA's Community Grants website Online. BABA requirements shall not apply to equipment or products procured under the BABA De Minimis Waiver. Bidders on this Work will be required to comply with the President's Executive Order Nos. 11246 (Equal Employment) as amended. Bidders shall also comply with Executive Orders 11625, 12138, and 12432; 40 CFR part 33; Section 129 of P.L. 100-590 Small Business Reauthorization & Amendment Act of 1988; Public Law 102-389 (42U.S.C. 437d); a 1993 appropriations act ("EPA's 8% statute"); Public Law101-549, Title X of the Clean Air Acts Amendments of 1990 (42 U.S.C. 7601 note) ("EPA's 10% statute"), encouraging recipients to award construction, supply, and professional service contracts to minority and women's business enterprises (MBE/WBE) and small business; and requiring recipients to utilize affirmative steps in procurement. The requirements for Bidders and Contractors under these orders are explained in the specifications. Bidders are advised that "fair share" target percentages have been established at 3.5% for Minority Business Enterprise participation in the Project and 5.0% for Women Business Enterprise participation in the Project.
