Athens State University Property Demolition Bid bonds are to be issued by anacceptable bonding company licensed to do business in the State,with a Power of Attorney, to confessjudgment thereon, with the understanding that it shall guarantee thatthe bidder shall not withdraw hisbid for the guarantee period of sixty(60) days after the scheduled closing time for the receipt of bids; that ifhis bid is accepted, he will enter intoa formal contract with the Owner,and that in the event of a withdrawal of said bid within said period, orthe failure to enter into said contractwithin the time specified, the biddershall be liable to the Owner for thefull amount of the bid guarantee asliquidated damages and not as aforfeit or as a penalty. The bid bondand certified checks on unsuccessful bidders will be returned uponawarding the contract or rejectionof all bids, in no event, later than thenumber of days in the guaranteeperiod from the opening of propos- als. That of the successful bidderwill be returned when formal con- tract and bonds are accepted andapproved. Bids must be submitted on proposalforms furnished by the Architect orcopies thereof. All bidders biddingin amounts exceeding that estab- lished by the State Licensing Boardfor General Contractors must be li- censed under the provisions of Title34, Chapter 8, Code of Alabama,1975, and must show evidence oflicense before bidding or bid willnot be received or considered bythe Architect; the bidder shall showsuch evidence by clearly displayinghis or her current license numberon the outside of the sealed envelope in which the proposal is delivered. The Owner reserves theright to reject any or all proposalsand to waive technical errors if, inthe Owner's judgment, the best interests of the Owner will thereby bepromoted. Any questions concerningthe pre-bid conference shall be directed to the Architect. Nonresident bidders must accompany any written bid documentswith a written opinion of an attorneyat law licensed to practice law insuch nonresident bidder's state ofdomicile, as to the preferences, ifany or none, granted by the law ofthat state to its own business entities whose principal places of business are in that state in the letting ofany or all public contracts.
