Pulis Avenue Manhole No. 50 Replacement The Pulis Avenue Manhole No. 50 Replacement project generally consists of removal and replacement of gravity manhole No. 50, which receives the force main discharge flow from the Franklin Lakes Pump Station, as well as the rehabilitation of downstream manhole No. 51. The project will also consist of constructing an 8" temporary force main extension to bypass the system and allow for the replacement of manhole #50, as well as all other Work of any type or description necessary for contemplation of the Project, whether or not specifically described in these Contract Documents. All Work on this Contract shall be completed within 120 Calendar Days from Notice to Proceed Bidders shall submit with the bid an electronic bid bond or electronic copy of a bid bond in the amount of ten percent (10%) of the total price bid, but not in excess of $20,000.00, payable unconditionally to the Northwest Bergen County Utilities Authority, along with a Certificate (Consent of Surety) with Power of Attorney for the full amount of the bid price from a Surety Company authorized to do business in the State of New Jersey and said Surety will furnish a consolidated Performance and Payment Bond in amounts of 100% of the successful Bidder's contract. Bidders shall comply with the "Prevailing Wage Act" N.J.S.A. 34:11-56.25 et se. and the Federal Davis Bacon Act. The Contractor shall pay the higher of the State or Federal wage rates. This Contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Infrastructure Bank. Neither the State of New Jersey, the New Jersey Infrastructure Bank nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10 [N.J.A.C.7:22- 3.17(d)]. The Contractor (subcontractor) shall comply with the provisions of N.J.S.A. 10:5-2.1 et seq., N.J.S.A. 58:11B-26, N.J.A.C. 17:27 et seq. and N.J.A.C. 7:22-3.17(a)24, and 4.17(a)24 and for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED). These regulations require that no less than 10 percent of the total amount of all contracts related to the project shall be awarded to SEDs. Successful bidder shall comply with SED Utilization Plan prepared by the OWNER. [N.J.A.C. 7:22-3.17(f)] The Authority intends to award this Project to the lowest Bidder whose Bid Packet is responsive in accordance with N.J.S.A. 40A:11-16 (c) and complies with its requirements for the Project, provided that in the judgment of the Authority is reasonable, within available funds and in the interest of the Authority. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4:17(a)24, the contractor (subcontractor) shall comply with all the provisions of N.J.A.C. 7:22-9. Bidders shall be required to comply with (a) the conditions of employment and requirements of Federal prevailing wage rates to be paid under the contract; (b) Section 3 of the HUD Act of 1968; (c) Prohibition of Segregated Facilities; (d) Section 109; and (e) E.O. 11246 Bidders shall comply with the requirements of N.J.S.A 10:5-31 and N.J.A.C. 17-27 et seq., and Bidders are required to comply with the requirements of P.L. 1975, c. 127. regarding affirmative action. Sealed bids for this project are being solicited through a fair Back and open process in accordance with N.J.S.A. 19:44A-20.4 et seq.
