Buyer Name Kylie Rush Buyer Email krush@lindenschools.org Buyer Phone 810-591-0989 The Linden Community Schools ("Owner" or "School District" or "LCS") will receive sealed Bid Proposals for: ASBESTOS ABATEMENT - CENTRAL ELEMENTARY SCHOOL 7199 SILVER LAKE ROAD, LINDEN, MICHIGAN 48451 Please be aware that there are areas in the facility with asbestos-containing materials; therefore, you should protect yourself according to what you feel is sufficient. In accordance with MCL 380.1267, each Bid Proposal must be accompanied by a sworn and notarized statement disclosing any familial relationship that exists between the owner or any employee of the bidder and any member of the Board of Education or the Superintendent of the Linden Community Schools. The Board of Education will not accept a Bid Proposal that does not include this sworn and notarized disclosure statement. Each Bid Proposal must be accompanied by a sworn and notarized statement certifying that the Contractor is not an Iran Linked Business. The Board of Education will not accept a Bid Proposal that does not include this sworn and notarized statement. Each Bid Proposal must be accompanied by a bid bond in the amount no less than five percent (5%) of the total bid amount(s). The Linden Community Schools Board of Education reserves the right to accept or reject any and all Bid Proposals, either in whole or in part, to waive any informalities or irregularities therein, or to award the contract to other than the contractor submitting the best financial Bid Proposal (low bidder), in its sole and absolute discretion. Bonding Requirements: LCS requires that all bidders submit a Bid Bond in accordance with the requirements summarized below and that all selected Contractors submit Performance Bonds and Labor & Materials Payment Bonds in accordance with the requirements summarized below: Bid Bond Amount: 5% Requirements: The Bidder shall submit the required Bid Security in the form of a Bid Bond by a Treasury approved surety licensed to do business in the State of Michigan, a Cashier's Check, or a Certified Check in the amount of 5% of the bid price made payable to Linden Community Schools. The Bid Security shall be submitted with the understanding that if the bid is accepted, the Bidder will enter into a formal contract with the Owner and that the required Performance Bond and Labor & Material Payment Bond (as listed below and fully detailed in the General Conditions section) will be provided by the Contractor. The Bid Security oblige is LCS. Bidders shall agree not to withdraw proposals for a period of thirty (30) days after the bid due date. Failure to furnish the Bid Bond by the time of bid opening may be cause for rejection of the bid. Bid bonds will be returned to unsuccessful bidders after bid opening. LCS reserves the right to retain security of the three lowest bidders until entered into contract with one of the bidders; or until thirty (30) days after bid opening date. If any bidder refuses to enter into a contract, LCS will retain the bid bond as liquidated damage. Performance Bond and Labor & Material Payment Bond Amount: 100% Requirements: The accepted Contractor will be required to furnish, at his request, prior to execution of the contract in the amount of 100% of the total Contract Price, satisfactory Performance Bond and Labor & Material Payment Bond by a Treasury approved surety, as listed on the U.S. Department of Treasury Circular 570, licensed to do business in the State of Michigan. The U.S. Department of Treasury Circular 570 can be viewed at website. The accepted Contractor will be required to furnish the bonds prior to the start of the project. The Labor & Material Payment bond shall comply with Michigan Public Act 213 of 1963 and the Performance bond will comply will Michigan Public Act 32 of 1956. Mobilization to the project site will not begin until acceptable bonds are furnished by the accepted Contractor.
