* IMPORTANT NOTE TO BIDDERS: All Addenda issued during the original, previous BP#16A Bid Period (Addenda #1 through #4) have been incorporated into the Bid #25CN-230 Bid Documents as the Volume 3 Specifications, Section 40 000 – Prior Addenda. New Addenda issued during the Bid #25CN-230 BP#16A Re-Bid Period start at Addendum #5. When acknowledging Addenda on the Bid Form (Section 00300), bidders are to also acknowledge Addenda #1 through #4 as included in Specification Section 40 000 – Prior Addenda. Bidders should note the requirements for Bid Security and Payment and Performance Bonds contained in the instructions to Bidders as modified by AACPS. Bids submitted without required bid security documents shall be rejected as not responsive. The amount of Payment and Performance bonds shall be determined by the ultimate award amount. If the sum of the Base Bid and all Alternate Bids is $100,000.00 or greater, the Bid shall be accompanied by a bid security in the form of a certified check in the amount of five (5) percent of the sum of the Base Bid and all Alternate Bids payable to Anne Arundel County Public Schools or surety bond in the amount of five (5) percent of the sum of the Base Bid and all Alternate Bids, pledging that the Bidder shall enter into a Contract with the Owner on the terms stated in the Bid and will furnish bonds covering the faithful performance of the Contract and payment of all obligations arising thereunder. Should the Bidder refuse to enter into such Contract or fail to furnish such bonds, the amount of the bid security shall be forfeited to the Owner as Liquidated Damages, not as a penalty. If the sum of the Base Bid and all Alternate Bids accepted by the Owner is $100,000.00 or greater, the Contractor shall, within fourteen (14) calendar days after Letter of Intent, furnish a Performance Bond and Labor and Material Payment Bond in the amount of not less than one hundred (100) percent of the total amount of the contract covering the faithful performance of the Contract and the payment of all obligations arising there-under. MBE Goal Percentage: 35% MBE goals set for trade 16A will have sub-goals of 8 % from certified African American-owned businesses, and 11 percent from certified Women-owned businesses. Liquidated Damages shall be $1,500.00 per calendar day due the Owner after expiration of the contract time for substantial completion. All Liquidated damages shall be assessed in accordance with the Contract Documents for this project.
