The wages paid to each laborer, worker, or mechanic in the employ of the Contractor, Subcontractors, Sub-subcontractors, or other persons or entities doing or contracting to do all or any part of the Work for a legal day's work will not be less than the prevailing rate of wages as defined by the Labor Law and as issued by the State of New York Department of Labour for the location and duration of the Project. No change in such prevailing rates during the duration of the Project will form the basis for a change in the Contract Sum. Bidders are required to furnish a Proposal Guaranty of 10 percent of the amount of the Proposal, either by bank cashier's check, payable to the owner, or Bid Bond, conforming to law, and satisfactory to Owner. The Contractor shall furnish bonds covering faithful performance of the Contract and payment of obligations arising under it. Bonds must be obtained from a surety company or companies satisfactory to the Owner, licensed to do business in the State of New York, and listed in the latest issue of U.S. Treasury Circular 570. The amount of each bond will be equal to one hundred (100) percent of the Contract Sum. Each bond must be maintained throughout the duration of the Project, and subsequently to the extent the Contractor has ongoing performance and payment obligations following completion of the Project.
