The OWNER reserves the right to reject any and all BIDS. BIDDER shall be properly licensed under Chapter 87, General Statutes of North Carolina. Small, minority, women's, and disadvantaged businesses and Labor surplus area firms are encouraged to submit bids. This PROJECT is subject to the good faith efforts and goals for participation by minority businesses required by G.S. 143-128.2. The OWNER has adopted a verifiable ten percent (10%) goal for participation by minority businesses in the total value of the WORK. BIDDERS shall, within the time frames specified in the BID documents, submit all required affidavits and documentation demonstrating that the BIDDER made the required good faith effort in compliance with G.S. 143-. Failure to file all required affidavits and documentation within the required time frames is grounds for rejection of the BID. Prospective BIDDERS who have been found guilty of discrimination within the last two (2) years are debarred from bidding. With each copy of the BIDDING DOCUMENTS, a BIDDER is furnished one separate unbound copy of the BID form and the BID BOND form. The unbound copy of the BID form is to be completed and submitted with all attachments outlined in the Bidder's Checklist attached to the unbound copy of the BID form. This Bidder's Checklist shall be the first page of all BIDS submitted. Each BID must be submitted in an opaque sealed envelope, addressed to the Town of Seaboard at Seaboard Town Hall, 102 West Central Street, Seaboard, NC 27876. Each sealed envelope containing a BID must be plainly marked on the outside as BID for ARPA Sewer System Improvements Contract No. 6 - Sanitary Sewer Replacement. the envelope should bear on the outside the name of the BIDDER, his address, his license number, if applicable, and the name of the PROJECT for which the BID is submitted. The BID shall be accompanied by the BID security and other required documents. If a BID is sent by mail or other delivery system, the sealed envelope containing the BID shall be enclosed in a separate envelope plainly marked on the outside with the notation "BID ENCLOSED. Each BID must be accompanied by a BID BOND payable to the OWNER for five percent of the total amount of the BID. As soon as the BID prices have been compared, the OWNER will return the BONDS of all except the three lowest responsible BIDDERS. When the AGREEMENT is executed the BONDS of the 00201 Page 2 two remaining unsuccessful BIDDERS will be returned. The BID BOND of the successful BIDDER will be retained until the PAYMENT BOND and PERFORMANCE BOND have been executed and approved, after which it will be returned. A certified or cashier's check may be used in lieu of a BID BOND. PERFORMANCE BOND and a PAYMENT BOND, each in the amount of 100 percent of the CONTRACT PRICE, with a corporate surety approved by the OWNER, will be required for the faithful performance of the CONTRACT. The Pre-Award Qualification Package shall demonstrate the apparent SUCCESSFUL BIDDER's qualifications and shall include financial data, previous experience, present commitments, and other data. The submittal shall include, but not be limited to, a restatement of the following items with the apparent SUCCESSFUL BIDDER's response following each respective item.
