The project aims to optimize space utilization and enhance functionality while ensuring minimal disruption to ongoing data center operations. All work shall be performed in accordance with the provided detailed plans and specifications. Scope of Work The scope includes, but is not limited to: Demolition: Removal of non-load-bearing walls and partitions. Renovation & Construction: Preparing the vacated data center area for office use by constructing new partitions, installing flooring, ceiling tiles, and painting. Electrical & IT Infrastructure: Installation of electrical outlets, data cabling, lighting, and HVAC modifications to support the new office layout. Fire Safety Compliance: existing to remain unmodified. Coordination with Ongoing Operations: While technical Data Center infrastructure work will be handled by others, the selected contractor must coordinate activities to minimize disruptions. Finalization: Relocation or installation of office furniture, final inspections, and readiness for immediate occupancy. The contractor shall be responsible for obtaining all necessary permits and ensuring compliance with local building codes. This project is also subject to compliance monitoring and enforcement by the DIR. Contractors must submit certified payroll records electronically to the DIR in accordance with California Labor Code Sections 1770, 1773, and 1773.1. DIR Registration Requirement This is a public works project, and all contractors and subcontractors must be registered with the Department of Industrial Relations (DIR) pursuant to Labor Code Section 1725.5 before submitting a bid. No contractor or subcontractor may be listed on a bid proposal for this project unless registered with DIR, except for limited exceptions under Labor Code Section 1771.1(a). No contractor or subcontractor may be awarded a contract for public work on this project unless registered with the DIR at the time of contract award. Insurance Requirements Before commencing work, the contractor shall obtain and maintain insurance as required by the contract documents. Insurance requirements are detailed in a separate attachment to this solicitation. Contractors must ensure that all subcontractors also obtain and maintain the required insurance coverage. Insurance coverage shall include, but is not limited to: General Liability Insurance Workers' Compensation Insurance Automobile Liability Insurance The contractor shall procure and maintain insurance for the duration of the contract to cover claims for injuries, damages to property, and other liabilities arising from the performance of the work by the contractor, its agents, employees, or subcontractors. Bid Requirements Related to Payments 1. Progress Payments: The District will process monthly progress payments based on percentage of work completed. 2. Certified Payroll Compliance: Payments will only be released once contractors submit certified payroll records per DIR requirements. 3. Retention: A 5-10% retention will be held in accordance with California Public Contract Code Section 9203. The final release of retention shall be made after final acceptance by the District. 4. Schedule of Values: Bidders must provide a detailed breakdown of costs in a Schedule of Values to align with these phases. 5. Final Payment: The last payment, including retention release, shall be made upon completion of punch list work, submission of closeout documents, and verification of compliance with contract terms. Prevailing Wage Requirements This project is subject to California Prevailing Wage Laws. The Director of the Department of Industrial Relations (DIR) has determined the prevailing rate of per diem wages for each craft or type of worker involved. 4.6 Firm Bid Bids shall remain firm for a period of one hundred twenty (120) days from the Bid Due Date/ Time unless otherwise specified in this solicitation. Prices submitted by Bidders are considered accurate and cannot be withdrawn after the bid is closed. 4.7 Withdrawal of Bid Bids may be withdrawn by the Bidders online through PlanetBids prior to the scheduled Bid Due Date/Time. 4.8 Award of Contract The award of a contract, if it is awarded, will be made to the lowest responsible and responsive Bidder. It is anticipated that any such award will be made within 90 days of Bid close date. The District reserves the right to reject any or all bids, to waive any irregularities and informalities in the bids and to make any award of contract in the best interest of the District. The District reserves the right to increase, decrease, or delete any item or number of items shown in the solicitation at any time. The unit prices shall remain firm should quantities be adjusted. Bid must be accompanied by cash, a certified check or cashier's check drawn on a bank in good standing, or a bid bond issued by a Surety authorized to issue such bonds in the State of California, in an amount not less than 10% of the bid price. This bid security shall be given as a guarantee that the Bidders will not withdraw the bid for a period of one hundred twenty (120) calendar days after the solicitation closing, and that if awarded a Contract, the successful Bidders will execute the Contract and furnish the Documents specified in the Contract documents. The Attorney-in-Fact (Resident Agent) who executes this bond on behalf of the Surety must attach a notarized copy of his power- of- attorney as evidence of his authority to bind the Surety on the date of execution of the bond.
