The Owner may reject any or all Proposals. Any Proposal may be withdrawn by the Proposer prior to the above-scheduled time for the submittal of Proposals or authorized postponement thereof. The Proposal must be signed by an individual authorized to bind the proposer. The Proposal shall contain a statement to the effect that the Proposal will remain valid for a period of at least one hundred twenty (120) days from the proposal opening. If the Owner is unable to award the Agreement within the time specified, the time may be extended by mutual agreement between the Owner and Proposer. Owner reserves the right, in its discretion, to offer all responsible Proposers, found by the Owner to have submitted proposals reasonably susceptible of being selected for award, an opportunity for discussion, negotiation, and revision, which shall occur after submission of Proposals but prior to any award. Design Submission means any and all documents, shop drawings, electronic information, including computer programs and computer generated materials, data, plans, drawings, sketches, illustrations, specifications, descriptions, models, and other information developed, prepared, furnished, delivered or required to be delivered by, or for, Design-Builder. Design Consultant is a qualified, licensed design professional who is not an employee of Design-Builder, but is retained by Design-Builder, or employed or retained by anyone under contract with Design-Builder, to furnish design services required under the Contract Documents. A Design Sub-Consultant is a qualified, licensed design professional who is not an employee of Design Consultant but is retained by Design Consultant or employed or retained by anyone under contract to Design Consultant, to furnish design services required under the Contract Documents.
