The General Terms and Conditions, Specifications, Special Provisions, Bid Form, Affidavit and Contract (if applicable) are on file and available to any interested person requesting a copy via email at purchasing@ohioturnpike.org. These documents will be forwarded, upon request and without charge, to any prospective Bidder. Each Bid must be on the form prescribed by the Commission and must comply with the terms and conditions set forth in all of the documents provided with this Bid Invitation. The award of the Contract, if any award be made, will be to the lowest responsive and responsible Bidder therefor whose Bid complies with all the prescribed requirements. The Commission reserves the right to reject any and all Bids and to waive minor technicalities or minor irregularities. A. Preparation of Bids: All Bids must be on the form prescribed by the Ohio Turnpike and Infrastructure Commission ("Commission"). The blank spaces in the Bid Form must be filled in correctly by the Bidder, where indicated and the Bidder must state the price for which the Bidder proposes to furnish the unit of materials or equipment for which Bids are solicited. If the Bid Form solicits Bids for more than one (1) such unit, the total extended price, based upon the number of such units, shall also be stated. In case the unit price and extension do not agree, the unit price shall govern, and the Commission is authorized to correct all erroneous extensions. The Bidder shall sign the Bid Form correctly. If an individual makes the Bid, the name and post office address must be shown. If made by a partnership or joint venture, the name and post office address of each member of the partnership or joint venture must be shown. If made by a corporation, the Bid must show the name of the state under the laws of which the corporation was chartered. B. Furnishing of Addenda: The Commission reserves the right to issue Addenda to this Invitation. A copy of each addendum (if any) will be furnished by the Commission to each person who furnishes their email address to purchasing@ohioturnpike.org. The Commission will make every effort to furnish the addendum at least seventy-two (72) hours prior to the Opening of Bids, excluding Saturdays, Sundays and legal holidays. The Bidder shall execute and return with its Bid an acknowledgement of any addendum issued. The Bidder should check the Commission's website, where all addenda are listed. E. Bid guaranty: if specified in the notice to bidders, no bid will be considered unless accompanied by a bid guaranty in the proper amount. The bid guaranty may be in the form of a combined bid guaranty/performance bond or certified check, cashier's check or letter of credit and shall be in the amount called for in the notice to bidders. If the Bidder wishes to submit a Bid Guaranty Bond, such Bond must be on the form approved by the Commission, and the appropriate Power of Attorney must accompany said bond or the Bid shall be rejected. A copy of said approved form is included in these Documents. If the Bidder wishes additional copies, they must be obtained from the Commission's Procurement Manager by making a written request to purchasing@ohioturnpike.org. Said Bid Guaranty will be held by the Commission as a guaranty that, if the Bid secured thereby be accepted, the Bidder will furnish the Performance Bond and Contract with the Commission in accordance with the Contract Documents The Bid Guaranty of the Bidder to whom the Contract is awarded will be returned promptly after having furnished the required Performance Bond. Cancellation of Bid Invitation: The Commission reserves the sole right, at any and all times, to cancel the Bid Invitation or any portion thereof prior to the scheduled Bid Opening.
