SCOPE AND PURPOSE 1.1. The Contractor shall remove and dispose of sludge and water from COTA premises, as described herein. Please see Exhibits A and B for analytical information on the sludge and water. (NOTE -The analytical results in Exhibits A and B are subject to change with changes in maintenance initiatives and the weather.) 1.2. All work shall be performed in strict accordance with the requirements of the Federal Resource Conservation and Recovery Act; the Federal Comprehensive Environmental Response, Compensation and Liability Act; Chapter 3734 of the Ohio Revised Code; and any federal or state regulations adopted pursuant to these provisions. 2. REMOVAL, DISPOSAL, AND IDENTIFICATION OF SLUDGE AND WATER 2.1. The Contractor shall remove the sludge and water from COTA premises. (NOTE - The vacuum trucks utilized on this Contract must be capable of entering COTA facilities, both of which have a height clearance of eleven feet six inches (11'-6"). The Contractor shall transport the sludge and water to the approved storage and disposal facility and arrange for their ultimate disposal. Disposal shall be accomplished in the following manner and priority: A. Incineration where the hazardous materials are able to be incinerated. B. Treatment or reclamation so that hazardous wastes are rendered to be harmless. C. Disposition in accordance with applicable federal, state and local law at a properly licensed facility. 2.2. The Contractor shall accept full title to the sludge and water when they are placed on, or into, the Contractor's vehicles. 2.3. Performance of the actual disposal operations shall include, but not be limited to, the following: A. Arrangements made by the Contractor to notify all appropriate agencies having jurisdiction over the transport of hazardous materials. B. The proper tagging and labeling for shipment of all items or materials picked up at COTA premises. C. Transport all such items or materials to approved storage/disposal facility, and perform testing, if not already accomplished, in order to determine hazardous 3-2 waste classification. D. Ensure that all containers of waste materials comply with, and are transported in full compliance with, all shipping, labeling, packaging and transportation requirements as specified in 49 C.F.R. Parts 171, 172, 173, 177, 40 C.F.R. Parts 261 and 263. E. Dispose of all hazardous materials in a fully lawful manner, and in compliance with facility standards of 40 C.F.R. PARTS 264, 265, 266, 268 and local law. 2.4. No draining or flushing of devices or containers having contained any form of hazardous materials may be performed at COTA premises unless prior written notification if given to, and written permission received from, COTA. 2.5. The Contractor shall dispose of all sludge and water picked up under this contract within ninety (90) days of pickup. The Contractor may request an additional 30-day extension provided that: (1) Contractor can demonstrate to the satisfaction of COTA that it is beyond their control to arrange for disposal within the original 90-day limit; and (2) they are in compliance with applicable EPA storage regulations.
