If a Bid is sent by mail or other delivery system, the sealed envelope containing the Bid shall be enclosed in a separate package plainly marked on the outside with the notation "BID ENCLOSED." Each bid shall be accompanied by a bidder's security in a sum equal to five (5) percent of the full amount of the bid in accordance with the Instructions to Bidders. The bidder shall submit a Bid Bond for security to McLean County. The bid security is a guarantee that the bidder, if awarded the contract, will enter into a contract for the work described in the contract documents. The bid security of the three (3) lowest bidders will be retained until the contract has been awarded and executed, but no longer than 90 days after the opening of bids. The successful bidder will be required to furnish contract Performance and Payment Bonds, each in the full amount of the contract. The Owner reserves the right to reject any or all bids and to waive informalities.
