The Authority reserves the right to reject any and all Bids. A non-mandatory pre-bid conference will be held at the time and location indicated in the Advertisement. Bidders are encouraged to attend and participate in the conference; however, attendance at this conference is not required to submit a Bid. Information presented at the pre-Bid conference does not alter the Contract Documents. Owner will issue Addenda to make any changes to the Contract Documents that result from discussions at the pre-Bid conference. Information presented, and statements made at the pre-bid conference will not be binding or legally effective unless incorporated in an Addendum. Bids must be accompanied by Bid security in an amount of five percent (5%) of Bidder's Bid price, and in the form of a Bid bond in a form and from a Surety in a form acceptable to the Authority, to the favor of the Authority, or a certified check made payable to the Monroe County Water Authority. The Bid security of the apparent Successful Bidder will be retained until Owner awards the contract to such Bidder, and such Bidder has executed the Contract, furnished the required Contract security, and met the other conditions of the Notice of Award, whereupon the Bid security will be released. If the Successful Bidder fails to execute and deliver the Contract and furnish the required Contract security within 15 days after the Notice of Award, Owner may consider Bidder to be in default, annul the Notice of Award, and the Bid security of that Bidder will be forfeited. Such forfeiture will be Owner's exclusive remedy if Bidder defaults. The Bid security of other Bidders that Owner believes to have a reasonable chance of receiving the award may be retained by Owner until the earlier of seven (7) days after the Effective Date of the Contract or ninety (90) days after the Bid opening, whereupon Bid security furnished by such Bidders will be released. Any Bid received after the time and date specified will not be considered. The Owner reserves the right to consider Bids for forty-five (45) days after the date of receiving and opening Bids, and reserves the right to accept any Bid or reject any or all of them. No Bidder may withdraw, alter or revoke a Bid within the 45 days after the actual date of the opening thereof. The Authority also reserves the right to reject any Bid unless the same contains an adequate or reasonable price for all items contained in the Bid, and further reserves the right to reject unrealistic or unbalanced Bids. The Owner does not assume responsibility for any unrealistic or unbalanced Bids that may be ultimately accepted, such responsibility lying solely with Bidder. The Authority requires Contractors to utilize their best efforts to achieve goals for Minority Business Enterprises (MBE's) and Women's Business Enterprises (WBE's) participation on the Project. On this project, that goal is a combined participation by MBE and WBE firms on a minimum of twelve percent (12%) of the total Contract Price. Further, neither the MBE nor WBE participation should be less than six percent (6%) of the total Contract Price. For this Procurement, the Procurement Officer is Tim Stevens, P.E. Substantial Completion: Contractor shall pay Owner $400.00 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified in Article 2.02 for Substantial Completion, until the Work is substantially complete in accordance with the Contract Documents. B. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the time specified in Article 2.02 (as such Contract Time may be duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $200.00 for each day that expires after the time specified in Article 2.02 until the Work is completed and ready for final payment. C. Owner and Contractor agree that the above amounts are reasonably proportional to the probable loss caused by the delay. Question Deadline 04/10/2025
