Site work and paving for a mixed-use development in Phillipsburg, New Jersey. Completed plans call for site work for a road / highway; for paving for a road / highway; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.

Town of Phillipsburg for Storm Sewer System Rehabilitation This project involves improvements to Town of Phillipsburg for Storm Sewer System Rehabilitation. Improvements include milling and paving, installation of curbing and sidewalk, installation of ADA compliant curb ramps, and replacement of driveway aprons. Sanitary and stormwater improvements include repair/replacement to various sewer pipes, resetting or reconstructing structures, and removal and installation of new stormwater inlets. Project also includes installation and replacement of traffic striping of roadway. Contract Documents may be obtained only from the office of the Engineer at the address and hours set forth upon payment of One-Hundred dollars ($100.00) for each set of Hard Copy Contract Documents. Bidder may receive a no cost electronic copy of contract documents through the office the Engineer upon calling the engineer's office and signing up for bid documents. All refunds must be forwarded in strict compliance with N.J.S.A. 40A:11-24(b). Bid Security is required in an amount of not less than ten percent (10%) of the total amount of the Bid, but not in excess of Twenty Thousand Dollars ($20,000.00) as set forth in N.J.S.A. 40A:11-21 CONSENT OF SURETY: Certificate from a Surety Company is required indicating consent to be bound as surety and guarantor for performance required under the Contract Documents. All Bids must be received either certified mail or overnight mail to the Town of Phillipsburg Municipal Building prior to Bid opening at the address. Bids will not be accepted after Bid date and time. Bidders are required to be registered by the NJ Department of Labor at the time bids will be received by the Project Owner pursuant to the Public Works Contractor Registration Act (P.L. 2003, c. 91, N.J.S.A. 34:11-56.51). Effective September 1, 2004, Bidders are also required to be registered by the NJ Department of Treasury, Division of Revenue at the time bids will be received by the Project owner pursuant to the Business Registration Act (P.L.2004, c.57, N.J.S.A.52:32-44). PUBLIC BID OPENING AND READING Place: Town of Phillipsburg Municipal Building 120 Filmore Street, Phillipsburg, NJ STATUTORY REQUIREMENTS: Bidders are required to comply with applicable statutory requirements set forth in the Contract Documents including the requirements of N.J.S.A. 10:5-31, et seq. & N.J.A.C. 17:27-1.1, et seq. (Affirmative Action); P.L. 1963, c. 150 (Prevailing Wage); Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et seq.); and P.L.2004, c.19 & P.L.2005, c.271 (Pay to Play). In addition, effective August 1, 2005, P.L. 2005, c.67 authorized a new form of change order called "Value Engineering Construction Change Orders." Please review these specifications to determine if this bid will involve this new form of change order for contracts that are estimated to exceed $5,000,000.00. All bidders please be advised that this project may be funded entirely or at least in part from a Federal assistance agreement between EPA and the Town of Phillipsburg. In accordance with State, local or tribal laws and regulation as well as Federal laws and Uniform Grant Guidance (UGG) 2 CFR Part 200 (i.e. procurement standards), 40 CFR Part 33 and/or 40 U.S.C. Part 1101 et seq., all bidders shall acknowledge the federal requirements and provisions for construction contracts including, but not limited to: the Davis-Bacon Act; EPA's Disadvantaged Business Enterprise (DBE) Program; Build America, Buy America (BABA) Act; and American Iron and Steel (AIS) Act." The contractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in termination of this contract or other legally available remedies. REJECTION OF BIDS: The Town of Phillipsburg reserves the right to reject any or all Bids, or to waive any Bid defect where such defect is not detrimental to the best interest of Town of Phillipsburg and fairness of the bidding process. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Contract Documents.
