Bid bond payable to the owner shall be submitted with each bid in the amount of 5 percent of the bid amount. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to accept or reject any and all bids, to re-advertise for new bids and to waive informalities and irregularities in connection with any bid. Bidders shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time. All potential bidders must self perform a minimum of 20% of the work associated with the contract that they submit bids for. Proof of self performance requirements shall be provided following the bid as required in the instructions to Bidders. Where two or more kinds, types, brands, manufacturers, or materials are named in these specifications, they are to be regarded as the required standard of quality and are presumed to be equal. The contractor may select one of these items or, if the contractor desires to use any kind, type, brand, manufacturer or materials other than those named in the specifications, the contractor shall indicate in writing, following the bid opening, when, and prior to the award of contract, what kind, type, brand, manufacturer or materials is included in the base bid for the specified item. Following the bid opening, the contractor shall provide all of the requirements of Section 016000 Product Requirements and Substitutions for use by the architect and owners representative in determining that a product or system is indeed equivalent. The owner reserves the right to accept or reject such submissions. Should such materials, products, devices, etc. be rejected, the contractor shall be obligated to conform to the specification requirements or approved equivalent with no charge in price. No substitution will be considered prior to receipt of bids. Bids shall be passed on to any one of the specified products. Bidders shall not use a product contemplated for substitution to establish proposal price. Where only one product is named, such designation has been made in order to match an existing condition exactly or otherwise suite the owners purpose. B. Contractor assumes the risk of an equivalent included in his or her bid being accepted under the process outlined in section 016000. No product will be evaluated as an equivalent prior to the bid opening. Pre-Bid RFI at least seven days prior to the bid opening, 2:00pm, local time. All questions are to reference a drawing number or specification section with page number.
