Bid security in the form of a bid bond or certified check in the amount of 5% of the bid payable to the Town of Brookline is re-quired. Bid security shall ecurity shall not be enclosed with the proposal but shall be delivered separately to the office of the Departmen of Public Works, attached to the outside of the bid proposal. The successful bidder shall furnish guar-antee bonds in the form of a performance bond and a payment bond, each in the amount equal to 100% of the bid, from a surety company satisfactory to the Town. Minimum wage rates have been fixed by the Massachusetts Department of Labor and In-dustries and shall be in conformance with Section 26 through Section 27G of Chapter 149 of the Massachusetts General Laws. The Town is an equal opportunity employer and will require compliance with its Affirma-tive Action program and with the Affirma-tive Actions stated in Article 4.4 of the Town by-law. The proposal pages shall be submitted for comparison of bids. The Commissioner of Public Works reserves the right t any or all bids, or to ac-the right to reject any or cept any bid, or to defer the start of work operations should she deem it in the best interest of the Town to do so. SCOPE OF WORK The work shall consist of the painting white and yellow Reflective Traffic Lane Lines and Legends on various streets in the Town of Brookline during the life of this Contract in accordance with the applicable provisions of the specifications and the following. Bidders shall provide a unit cost for each item. Bidders shall note that the Contract will be awarded to up to three (3) responsible and eligible bidders offering the lowest total price per year for all the items of work. Primary, Secondary and Tertiary contracts will be awarded for portions of the work under the overall Contract as determined by the Town. The successful bidder for the Primary Contract shall furnish payment and performance bonds in the amount of 100% of their bid less the value of any Secondary and Tertiary Contracts subsequent to award. The successful bidders for any Secondary and Tertiary Contracts shall furnish payment and performance bonds in the amount of their respective portions of the work subsequent to award. Contractors should note that their payment and performance bonds shall not be less 100% of the actual value of their portion of the work under their Contract and they may be required to increase the amounts of their payment and performance bonds accordingly. This contract will begin on or before July 1, 2025 and end at the close of the fiscal year (FY-2026) on June 30, 2026. The Town of Brookline has the option at its sole discretion to extend the contract at the same prices for an additional two (2) years (FY-2027, FY-2028) on a year to year basis. Beacon Street in-bound will be painted one week before the annual running of the Marathon held on the 3rd Monday of April. All other spring painting will be finished by May 31 of each year. Fall painting will be finished by October 31 of each year. The Town will award the Contract to the responsible qualified bidder, as determined by the Commissioner of Public Works, with the lowest total base bid. A. The Department of Public Works reserves the right to reject any or all bids if the Contractor fails to satisfy the Commissioner of Public Works as to the availability of proper equipment of standard commercial manufacture, trained personnel or other facilities necessary to the proper fulfillment of the contract. B. The Department of Public Works can request the Contractor to complete a work order within one month. C. Department of Public Works further reserves the right to halt all work any time it appears that the work is not proceeding at the indicated rate or if the work fails to meet a standard at least equal to that performed by the traffic crews of the Department. D. The Contractor will list, among other information all equipment on hand or immediately available and under the control of the bidder as of the date of this bid. Department of Public Works reserves the right to inspect and examine all equipment reputed as available for this work at any time after the bids are received.
