The successful Bidder, upon his/her failure or refusal to execute and deliver the contract and bonds required within ten (10) days after he/she has received notice of the acceptance of his/her bid, shall forfeit to the City, as liquidated damages for such failure or refusal, the security deposited with his/her bid. Upon signing and returning the Construction Contract to the CITY for final approval and execution, the Contractor shall, at the Contractor's expense, furnish to the CITY a Performance Bond in an amount equal to 100% of the Contract Sum and a Payment Bond, in an amount equal to 50% of the Contract Sum.
