The Town of New Milford is soliciting competitive bids from qualified firms for annual catch basin cleaning services. The Town reserves the right to accept or reject any and all bids in part or in whole. The awarded contractor shall be responsible for providing the cleaning of catch basins by the vacuum method. Upon completion of each job, catch basins must be free of debris to a degree that will ensure their efficient operation. Each basin shall be photo documented and the photo file submitted to the foreman daily. Such degree of cleanliness is to be reasonably determined by the highway foreman or their designee. The contractor may be re-called to re-clean any unsatisfactorily cleaned basin(s) without charge. The awarded contractor shall be responsible for the proper disposal of all materials collected during the cleaning process at a DEEP permitted waste disposal facility. Bid prices furnished on a per basin basis shall cover the disposition of materials at a DEEP permitted waste disposal facility. Prices shall remain in effect for one (1) year following the award of the bid. The town reserves the right to extend this contract an additional two (2) years upon mutual written agreement with the successful bidder. 6.6. Basis of Award The following factors will be considered in selecting a contractor: Lowest cost responsible bidder The ability, capacity and skill of the bidder to supply the services required Whether the Bidder can provide the service within the specified time, without delay or interference The Town reserves the right to award the bid in full or by individual items 6.7. Non-Employment Relationship The Town and the successful bidder are independent parties. Nothing contained in the Contract shall create, or be construed or deemed as creating, the relationships of principal and agent, partnership, joint venture, employer and employee, and/or any relationship other than that of independent parties contracting with each other solely for the purpose of carrying out the terms and conditions of the Contract. The successful bidder understands and agrees that it is not entitled to employee benefits, including but not limited to workers compensation and employment insurance coverage, and disability. The successful bidder shall be solely responsible for any applicable taxes.
