Site work for a water / sewer project in Middletown Township, New Jersey. Completed plans call for site work for a water / sewer project.

The provided Bid Packet must be completed in the manner designated in the Contract Documents, must be enclosed in a sealed envelope bearing the name and address of the Bidder and the name of the Project on the outside and must be addressed to the Monmouth County Bayshore Outfall Authority, 200 Harbor Way, Belford, NJ 07718. Also, Bid Packets must be accompanied by a Statement of Consent of Surety from a surety company holding a Certificate of Authorization to do business in the State of New Jersey and either a Bid Bond or a Certified Check drawn to the order of "Monmouth County Bayshore Outfall Authority" for not less than ten percent (10%) of the total bid price amount, except that the check shall not exceed $20,000.00. The successful Bidder is hereby notified that a Performance and Payment Bonds for the full amount of this Project is required. The award of the Contract for this Project will not be made until the necessary funds have been provided by the Monmouth County Bayshore Outfall Authority in a lawful manner. Please be advised that this Project is being funded through the Monmouth County Bayshore Outfall Authority. By virtue of Executive Order #34 (1976), vendors currently suspended, debarred or disqualified are excluded from participating on this Project. The successful Bidder shall be required to comply with the applicable statutory requirements of the Contract Documents and Plans which include all of the following: (i) N.J.A.C. 17:27; (ii) N.J.S.A. 10:5-31 et seq.; (iii) Business Registrations (N.J.S.A. 52:32-44); (iv) Prevailing Wage Act (N.J.S.A. 34:11- 56.25, et seq.); (v) Public Work Contractor Registration (N.J.S.A. 34:11-56.48); and (vi) Affirmative Action Requirements (N.J.S.A. 10:5-1, et seq.); and any other legal requirements applicable to this Project. The Monmouth County Bayshore Outfall Authority intends to award this Project to the lowest Bidder whose Bid Packet is responsive and complies with its requirements for the Project, provided that in the judgment of the Monmouth County Bayshore Outfall Authority is reasonable, within available funds and in the interest of the Monmouth County Bayshore Outfall Authority. The Monmouth County Bayshore Outfall Authority reserves the right to reject any and all Bid Packets to the extent permitted by law. An award will be made or Bid Packets will be rejected within sixty (60) Calendar Days after the opening of the Bid Packets, during which time the Bid Packets shall be irrevocable and unavailable to withdraw by Bidders, unless otherwise extended in the Contract Documents. The Monmouth County Bayshore Outfall Authority further reserves the right to modify this Contract through the distribution of Addenda to plan holders of record without further publication. Bids will be evaluated on the basis of this Advertisement plus any Addenda issued by the Monmouth County Bayshore Outfall Authority prior to the opening of the Proposal. This procurement will be subject to regulations contained in applicable sections of the New Jersey Local Public Contracts Law in effect on the date of the assistance award for this project. Under the terms of any contract awarded under this invitation for bids, the successful bidder shall fully comply with the requirements, terms, and conditions of the NJDEP's Socially and Economically Disadvantaged Individuals (SEDs) Regulations, NJAC 7:22-3.17(a)24, 7:22-4.17(a), or 7:22-6.17(a)24, and 7:22-9.1 et seq. Bidders are required to comply with the requirements of P.L. 1975, c127. Contractor must award not less than 10% of the costs for construction, materials, or services to small business concerns owned and controlled by SEDs and must comply with the Project Plan developed by the Owner fulfilling SED utilization. All applicable surety bonds required in connection with the advertisement and award of building contracts or sub agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570 Surety Companies Acceptable on Federal bonds), incorporated herein by reference. Copies of this document may be obtained from the Department. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10, Local Public Contract, Department of Labor Current Wage Rate Determination, Prevailing Wage Act, Contract Works Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, Debarment and Suspension, and Socially and Economically Disadvantaged according to N.J.A.C. 7:22-3.17(d), 4.17(d). Funds for this project are to be provided by the New Jersey Environmental Infrastructure Financing Program. Therefore, the successful bidder shall be required to comply with the provisions of the New Jersey prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964, and the Public Works Contractor Registration Act (NJSA 34:11-56.48). *The list of planholders and/or interested bidders is not being tracked by the stakeholders involved with this project.
