This Solicitation is for awarding a firm, fixed-price purchasing contract to cover a one (1) year term and may be renewed up to a maximum of four (4) years. FINANCIAL EXPECTATIONS The City's Energy Resources Department is anticipating an annual contract spend around $500,000.00. The Mesa Electric Service Area is located in Mesa, Arizona. The equipment will be exposed to high ambient temperatures, and subject to high dust levels and windy conditions. Bidders will address the extreme operating environment in Arizona for their equipment for this application, and clearly identify any special operating requirements or operational limitations in their proposals. The City of Mesa operates a 15 kV underground electric system. These specifications outline the general requirements for the furnishing of dead front gas insulated pad mounted switchgear and optional equipment. The proposal document requires proposal prices for three (3) switchgear arrangements and establishes unit pricing for one (1) year open contract. The City of Mesa will order switchgear on an as needed based upon the initial pricing for a period of one (1) year. Pricing for the subsequent years will include metal escalator/de-escalator indices as offered by the bidders. The initial proposal quantities will establish the basis for proposal evaluation and the initial intended order. Subsequent orders for additional units will be at the option of the City of Mesa. Offerors shall provide detailed equipment descriptions, pictures, dimensions, and circuit diagrams for the specified switch configuration. Optional equipment pricing shall also be provided. The City of Mesa may order from one or all categories listed on the Pricing and Compensation form depending upon specific project need. An estimated annual order of eight (8) switches, however, section 2.1 and 5.1 apply. All exceptions to the proposal must be clearly stated on the Exceptions, Confidential & Additional Materials. A list of qualified Contractors will be created from the Respondents who are successfully awarded a contract from this solicitation. The City will then issue a Request for Quote to the awarded Contractors for specific orders on an as-needed basis. Contractors will provide a quote (including pricing and lead times) for that specific order. In a timely manner, the City will select the Contractor based on a combination of the acceptability of Contractors proposed lead times, a cost analysis (which may include a present worth analysis of the lifetime cost of the transformers), and the acceptability of the warranty provided for the switches. The City will then issue a Delivery Order (DO) to the Contractor who meets their needs. Delivery Orders (DO) should be acknowledged within five (5) business days of receipt of Delivery Order (DO) or as soon as possible. . City may purchase the services or materials required under the Agreement from the open market, complete required work itself, or have it completed at the expense of Contractor. If the cost of obtaining substitute services exceeds the contract price in the Agreement, City may recover the excess cost by: (i) requiring immediate reimbursement by Contractor to City; (ii) deduction from an unpaid balance due to Contractor; (iii) collection against the proposal and performance security, if any; (iv) collection against liquidated damages (if applicable); or (v) a combination of the aforementioned remedies or other remedies as permitted by law. Costs in this Subsection (b) include any and all, fees, and expenses incurred in obtaining substitute services and expended in obtaining reimbursement including, but not limited to, administrative expenses, attorneys' fees, and costs. Vendor may propose functionally equivalent alternate equipment as an alternate to the base proposal; however, the City of Mesa reserves the right to reject alternate proposals.
