In accordance with and as described and provided in the plans, specifications and the proposed form of contract therefore, all of which are on file in the office of the Department of Public Works, and to which special reference is hereby made. In general, the project will construct an interconnected surface water triple completion monitoring well. No verbal, telegraphic, electronic mail, facsimile, or telephone Proposals shall be considered. Proposals are required to be complete and for the entire work, materials and improvements unless the contrary is indicated in the specifications. The DBE Goal is Zero, however the use of DBE firms are encouraged. In accordance with the provisions of California Business and professions Code, Section 7028, Contractor shall possess one of the following Contractor license(s) at the time of bid and for the duration of the contract: 1. C-57 Well Drilling Contractor Failure to possess a specified license shall render the Bid as non-responsive, shall act as a bar to award of the contract to any Bidder not possessing said license(s) at the time of Bid opening and shall result in the forfeiture of the security of said Bidder. Furthermore, any Bidder or Contractor not so licensed shall be subject to all legal penalties imposed by law, including, but not limited to, any appropriate disciplinary action by the Contractor's License Board. Each proposal must be accompanied by cash, cashier's check, or check certified by a responsible bank, or by a bid bond, the proposed form of which is on file in the office of the Public Works Director of said County and to which special reference is hereby made in a sum not less than ten percent (10%) of the total amount bid, payable to the County of Merced as liquidated damages in the case the bidder is awarded the contract and fails within ten (10) days after the date of mailing to him by the Public Works Director of a notice of award of the contract and that the contract is ready for signature to execute the above-mentioned.
