sealed bids for the replacement of three natural gas fired boilers at the Hamilton-Wenham High School The Project consists of the replacement of (3) gas fired cast iron sectional boilers, with selective demolition of the existing hot water distribution piping and associated branch circuitry within the boiler room to facilitate the installation of (3) high efficiency stainless steel condensing boilers. The Mechanical Contractor will be the prime contractor with Electrical, Plumbing, Masonry, and Roofing trades as subcontractors to the prime contractor. Applicable Law. All bids for this Project are subject to the provisions of Massachusetts General Laws, M.G.L. c. 149, 44A- 44J, the provisions of which are incorporated herein by reference and shall control in the event of any conflict among these provisions and the provisions of the bid documents. It is the responsibility of every bidder to know the requirements of M.G.L. c. 149 44A-44J. The bidder agrees that this bid shall be good and may not be withdrawn for a period of 30 days, Saturdays, Sundays, and legal holidays excluded, after the opening of bids. DCAMM Certification. General bidders must be DCAMM certified in the category of HVAC. Prevailing Wages and Employees. Wages are subject to prevailing wage rates as per Massachusetts General Laws Chapter 149. The contractor must ensure that employees and applicants for employment are not discriminated against because of race, color, age, religion, sex or national origin. Attention is also called to requirements relating to worker's compensation, OSHA certifications and conditions of employment. Every bid shall be accompanied by a bid deposit, in an amount not less than five percent (5%) of the bid amount, in the form of a certified check; or a treasurer's check; or a cashier's check; issued by a responsible bank or trust company, made payable to the Hamilton-Wenham Regional School District; or a bid bond in the form included with the bid documents, with a surety company qualified to do business in the Commonwealth of Massachusetts, and conditioned upon the faithful performance by the principal of the agreements contained in the respective bid. Bonds. The successful bidder will be required to provide a performance bond equal to one hundred percent (100%) and a labor and materials payment bond equal to one hundred percent (100%), issued by a company authorized to do business in Massachusetts and satisfactory to the District. The District reserves the right to accept and/or reject any and all bids and waive any informality in bidding procedures to the extent allowed by law and make the award as may be deemed to be in the best interest of the District. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof.
