Site work and paving for a civil project in Smyrna, Delaware. Completed plans call for paving for a road / highway; for site work for a water / sewer project; and road / highway.

This Community Workforce Project is a component of the Pilot Program authorized under Section 34 of Senate Bill 160, also known as the FY 2024 Bond Bill. As contemplated by the FY 2024 Bond Bill, and as memorialized in that certain Memorandum of Understanding ("MOU") between OMB and Delaware Building and Construction Trades Council, on behalf of itself and its affiliates and members, OMB has established for this project a union workforce goal of fifty percent (50%), meaning that 50% of all of labor-person hours for the entire project will be performed by union workers. As required by the FY 2024 Bond Bill, the awarded contractor will be required to enter into an agreement with OMB in furtherance of the Pilot Program. Under the Pilot Program agreement, the awarded contractor will be required to honor its union labor commitments and will have mandatory reporting requirements. The MOU and the form of Pilot Program agreement are included as attachments to the Instructions to Bidders. Bids will be evaluated on a form of "best value," which is described in the Instruction to Bidders, based upon lowest price, fastest schedule, and a plan outlining how the contractor proposes to achieve the union workforce percentage. The awarded contractor may achieve the union workforce percentage by: (1) utilizing its own collective bargaining agreements; (2) contracting with subcontractors that have collective bargaining agreements; and/or (3) making other arrangements that permit the contractor or its subcontractors to hire local union workers. The project involves the improvement of Sunnyside Road from its intersection with US-13 to the southern property line. Work includes, and is not limited to the following: mill and overlay, shoulder widening, auxiliary lanes, intersection improvements, grading, storm drainage, shared use path, maintenance of traffic, etc. Upon registering, the bidder will receive electronic access to the bidding documents via an e-mail notice. It is the responsibility of each bidder to review and coordinate all Project Documents. This includes plans, specifications and addendums. Bidders will not be subject to discrimination on the basis of race, creed, color, sex, sexual orientation, gender identity or national origin in consideration of this award, and Minority Business Enterprises, Disadvantaged Business Enterprises, Women-Owned Business Enterprises and Veteran-Owned Business Enterprises will be afforded full opportunity to submit bids on this contract. Each bid must be accompanied by a bid security equivalent to ten percent of the bid amount and all additive alternates. The successful bidder must post a performance bond and payment bond in a sum equal to 100 percent of the contract price upon execution of the contract. The Owner reserves the right to reject any or all bids and to waive any informalities therein. The Owner may extend the time and place for the opening of the bids from that described in the advertisement, with not less than two calendar days' notice by certified delivery, facsimile machine or other electronic means to those bidders' receiving plans. Additional documents including plans are available from the owner. Bids will be evaluated on a form of "best value," which is described in the Instruction to Bidders, based upon lowest price, fastest schedule, and a plan outlining how the contractor proposes to achieve the union workforce percentage. The awarded contractor may achieve the union workforce percentage by: (1) utilizing its own collective bargaining agreements; (2) contracting with subcontractors that have collective bargaining agreements; and/or (3) making other arrangements that permit the contractor or its subcontractors to hire local union workers. \ Question Deadline 07/17/2025 Bidders or Sub-bidders requiring clarification or interpretation of the Bidding Documents shall make a written request to the Architect at least seven days prior to the date for receipt of Bids. Interpretations, corrections and changes to the Bidding Documents will be made by written Addendum. Interpretations, corrections, or changes to the Bidding Documents made in any other manner shall not be binding.
