Tern Bay Community Development District (District) will acceptproposals from qualified firms (Proposers) interested in providing Bridge Repairs And Wear SurfaceReplacement services, all as more specifically set forth in the Bid Packet. In order to submit a proposal,eachProposer must (1) be authorized to do business in Florida and hold all required state and federallicenses in good standing; and (2) have at least five (5) years of experience with Bridge RepairsAnd Wear Surface Replacement projects. Failure to timely file a notice of protest or failure to timely file a formal written protest shallconstitute a waiver of any right to object or protest with respect to aforesaid plans, specifications orcontract documents. Any person who files a notice of protest shall provide to the District,simultaneous with the filing of the notice, a protest bond with a responsible surety to be approvedby the District and in the amount equal to One Hundred Thousand Dollars ($100,000.00). In theevent the protest is successful, the protest bond shall be refunded to the protestor. In the event theprotest is unsuccessful, the protest bond shall be applied towards the Districts costs, expenses andattorneys fees associated with hearing and defending the protest. The District reserves the right in its sole discretion tomake changes to the Bid Packetup until the time of the Bid proposal opening. The Board has not assigned numerical values for any of thesefactors and instead shall evaluate each proposal as a whole and need not choose the lowest-pricedproposal. Instead, the Districts Board shall rank the proposals in the Boards sole discretion and inthe best interests of the District. The District has the right to reject any and all proposals and waiveany technical errors, informalities or irregularities if it determines in its discretion, it is in the bestinterest of the District to do so.
