Doc note: The full amount of the deposit will be returned to all Contractors submitting a bona fide bid, except the apparent low bidder, upon return of all documents in good condition within ten (10) days after the date of opening of bid. The apparent low bidder's deposit will not be returned. Contractors requesting mail delivery of bidding documents will be charged a handling fee of $10.00 per set. Additional sets of bidding documents may be obtained by Sub-bidders and Suppliers for a non refundable fee of $50.00 per set. To obtain approval to use unspecified products or materials, prime bidders shall make a verbal request to the Engineer before the bid date and hour. Any interpretation or corrections will be issued through a written addendum by the Engineer. Only an interpretation, correction or change by written addendum will be binding. No bidder shall rely upon interpretation or correction given by any other person or method than by addendum. Each bid shall be accompanied by a certified check payable to the Owner or a Bid Bond naming Maryville City Schools as obligee thereof, underwritten by a surety company licensed to do business in Tennessee, in the sum of 5% of the amount of the bid. The certified check or Bidder's Bond is required to guarantee that, if the bid is accepted, that the bidder will honor the bid and complete the project in accordance with the terms set forth in the bid documents. The successful bidder will be required to execute a Performance and Payment Bond covering and including labor and materials in an amount equal to 100% of the contract price on AIA Document 312a, or such other bond forms as may be approved by the Owner. All bidders shall be licensed contractors in the State of Tennessee. All bidders should include a completed Drug-Free Workplace Affidavit form with submitted bid package. The bidder's name, license number, license expiration date and that part of classification applying to the bid shall be placed on the outside of the envelope containing the contractor's bid and the envelope shall be plainly marked "John Sevier Elementary School RTU Replacement". In addition, all major sub-Contractors names, license number and expiration dates shall be placed on the outside of the bid form. No Bidder will be permitted to withdraw his bid within ninety (90) days after the date of opening of bids. Upon award of the contract to the successful bidder, construction shall commence on a date to be specified in the "Notice to Proceed" to the Contractor and shall be completed on or before the completion date specified therein as time is of the essence in the performance of the contract for construction. All work included shall be Substantially Complete on or before October 13th, 2025. The contractor shall accept the conditions for liquidated damages in the amount of $500 per calendar day, if all work on the project is not substantially complete on or before October 13th, 2025. That the right is reserved by the Owner to reject any or all bids and to waive any informalities in bids received.
