All Bidders must be pre-qualified in conformance with Ohio Department of Transportation requirements. Each bidder is required to furnish with its proposal a Bid Guaranty and Contract Bond in accordance with Section 153.571 of the Ohio Revised Code. Bid security furnished in Bond form, shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety. Each proposal must contain the full name of the party or parties submitting the proposal. Bidders must comply with the prevailing wage rates on public improvements in Hancock County, Ohio as determined by the Ohio Department of Commerce. The Hancock County Commissioners reserve the right to waive irregularities and to reject any or all bids submitted on any basis and without disclosure of a reason. The failure to make such a disclosure shall not result in the accrual of any right, claim, or cause of action by any successful bidder against Hancock County or the Board of Hancock County Commissioners. Hancock County Dispute Resolution and Administrative Claims Process Hancock County Engineer will process all disputes and claims for locally administered projects. Disputes include disagreements on site conditions, extra work, or other unforeseen issues. The Contractor will follow the 3 Step process. Subcontractors and suppliers must pursue disputes and claims through the prime contractor. The goal is to resolve disputes and claims at the lowest level step possible. Step 1 must be exhausted prior to moving to Step 2. Resolution can be financial compensation or additional time added to the contract, all by change order. Step 1 Project Level When a Contractor thinks there is additional work beyond the scope of the project due to changed site conditions or other unforeseen cause that result in a claim, he will contact the project inspector and engineer immediately and meet to make the issue known. Within two (2) working days the project engineer will provide an answer to the Contractor to either accept the claim and process a change order or time extension or deny the claim and the process will proceed to Step 2. Step 2 County Engineer Level If an on-site resolution cannot be made, the Contractor must submit the claim in writing to the County Engineer. The claim should include details about the issue and any costs incurred. ODOT may be contacted by the County Engineer at his discretion for additional input. The County Engineer will meet with the Contractor's representative and the County field project staff to try to resolve the issue. The County Engineer will visit the site and investigate the merit of the claim. Within five (5) working days the County Engineer will notify the Contractor in writing of his decision. If the Contractor disagrees with the decision, he may proceed to Step 3.
