The Award of a Contract resulting from this Request for Quote shall be based on Total Quote Price submitted by Contractor. In case of mathematical errors, the unit price will govern. All Quotes shall be accompanied by a Bond (Attachment B) from a surety company selected by the Contractor, which is legally authorized to do business in Virginia in the amount of five percent (5%) of the amount of the Quote if the Quote price is in an amount of or over $200,000. If the Quote price is less than $200,000 the County may ask for a Bond after the opening of the RFQ and performance and payment bonds before work commences. In lieu of a Bond, a Contractor may furnish a certified check or cash escrow in the face amount required for the bond The successful Contractor shall furnish a Performance Bond in an amount equal to one hundred percent (100%) of the Contract Sum as security for the faithful performance of this Contract and also a Labor and Material Payment Bond in an amount not less than one hundred percent (100%) of the Contract Sum, as security for the payment of all persons performing labor and furnishing materials under this Contract, so long as the Contract Sum exceeds $200,000. If a contract is under $200,000 the County may request the bonds in accordance with the Spotsylvania County Procurement Policy. The Performance Bond and the Labor and Material Payment Bond shall be in separate instruments acceptable to the County, in accordance with State law and shall be delivered to the County not later than the date of execution of the Contract. The surety shall be such surety company or companies that are acceptable to the County and that are authorized to transact business in the Commonwealth of Virginia.
