The Cream Ridge Road Highwall Reclamation Project is on a pre-law coal mine site. The project site is in the central portion of Columbiana County, southeast of the village of Lisbon, in Elk Run Township. The project site does not have a physical address. The project site is located across from 42989 Cream Ridge Road, Lisbon, Ohio 44432. The Lat Long for the project site access drive is: 40.742501, -80.689294 The project site consists of a dangerous highwall, associated hazardous water body, and steep spoil piles. The features are located on property owned by Peters Farm LLC. The dangerous highwall is wishbone shaped, is approximately 3,025 feet in total length, has an average height of approximately 46 feet above the surface of the impoundment, and a maximum height of approximately 60 feet. The impoundment has insufficient discharge structures and steep side slopes. The highwall is located within 100 feet of Beaver Creek State Park. A cabin is located on top of a steep spoil pile, within 10 feet of the edge, and approximately 40 feet above the hazardous water body. Numerous camping sites have been constructed above the highwall and on top of the spoil piles. The Boy Scouts of America regularly utilize the property for scouting activities. The Division may issue an Addendum and will provide such by electronic transmission to all parties recorded by the Division as having attended the pre-bid meeting. The Addendum will be available for viewing and download from Division's Electronic Processing System along with all other contract documents. Each Bidder shall ensure that its bid is responsive to all Addenda issued. Failure to receive or acknowledge any Addenda shall not release the Bidder from all obligations contained in such Addenda. All Addenda shall become part of the Contract Documents. No other interpretations or clarifications issued prior to the opening of the bids will have legal effect. Receipt of Addenda shall be noted on the Bid Schedule. Any Addendum shall be deemed to have been validly given if it is delivered via electronic transmission or published on the Division's Electronic Processing System. If any Addendum is issued within seventy-two (72) hours prior to the published time for the bid opening, excluding Saturdays, Sundays and legal holidays, the bid opening shall automatically be extended one (1) week, with no further advertising required. Any interpretation or clarification of the Contract Documents made by any person other than the Division, or in any manner other than a written Addendum, shall not be binding and the Bidder shall not rely upon any such interpretation or clarification. The Bidder shall not, at any time after the execution of the Contract, be compensated for a claim alleging insufficient data, incomplete, ambiguous, conflicting, or erroneous Contract Documents, any discrepancy on or between Contract Documents, or incorrectly assumed conditions regarding the nature or character of the work if no request for interpretation or clarification regarding such matter was made by the Bidder prior to the bid opening.
