A certified check or bank draft drawn on a solvent bank in the State of Indiana, payable without condition to the City of Elkhart, or a satisfactory bid bond executed by the bidder and surety company in an amount not less than five (5) percent of the bid, shall be submitted with each bid. Any deviation from the bid documents must be explained by the bidder. The Board will award a contract to the lowest responsive and responsible bidder. The Board reserves the right to waive informalities or irregularities, and to reject any and all bids or portions thereof.
