The work to be performed in this improvement shall consist of the construction of a system of paved public sidewalks and multi-use trails of varying width with Portland Cement Concrete with a varying thickness, together with curb ramps, detectable warning panels, imprinted median surfacing, seeding and matting, and any and all necessary appurtenances and other work that is incidental and necessary for a completed improvement. The amount of the engineer's estimate of the cost of said improvements (exclusive of engineering, fiscal, legal, interest, easement acquisition, and miscellaneous costs). The Engineer is the final authority regarding all questions concerning the quality or acceptability of the work. Decisions made by the Engineer are final. The Engineer has executive authority to enforce the Contract. The Engineer reserves the right to suspend all or any part of the work at any time. Sanitary and Improvement District No. 376 of Sarpy County, Nebraska, reserves the right to reject any or all bids received and to waive informalities and irregularities. The undersigned hereby agrees to commence work within FIVE (5) working days after written Notice to Proceed and further agrees to complete the work to substantial completion within a period of THIRTY-FIVE (35) working days for the entire project after date of said Notice to Proceed, or after the start of construction, whichever occurs first. The undersigned shall forfeit liquidated damages as set forth in the General Provisions in the event of the over-run of time. Liquidated damages will be assessed not as a penalty, but as a predetermined and agreed liquidated damages.
