Construction Management at-Risk services for the Athens ISD 2025 Bond consisting of (Athens High School Additions & Renovations, Athens Middle School Additions & Renovations, New Early Childhood Center, Bel Air Elementary Renovations, South Athens Elementary Renovations, and Central Athens Elementary Renovations). The successful firm will be required to enter into an Owner/Construction Manager Agreement, Document AIA A133-2019, as modified by Supplementary Conditions to the Standard Form of Agreement Between Owner and Construction Manager with the Athens Independent School District and to furnish Performance and Payment Bonds through an approved bonding company duly authorized to do business in the State of Texas and currently listed in the Department of Treasury Federal Register in an amount of not less than 100% of the contract price, conditioned upon the performance of the contract. Attention is called to the fact that the Construction Manager must comply with all Federal, State and local labor laws, including Chapter 2258, Texas Government Code, Title 10, and the prevailing minimum wage rates as set by the Athens ISD Board of Trustees. All parties acknowledge the right of the Owner to reject any or all of the Proposals and to waive any informality or irregularity in any Proposal received. By submitting a Proposal, each Bidder agrees to waive any claim it has or may have against the Owner, the Architect/Engineer and their respective employees arising out of or in connection with the administration, evaluation or recommendation of any Proposal. Pursuant to the provisions of the Texas Education Code Section 44.031, it is the intent of the ATHENS ISD to select a Construction Manager-at-Risk via a ONE STEP PROCESS. The Owner shall use the following criteria for selection of a Construction Manager: reputation of vendor, past relationship with the District, experience with similar projects, price to District for services, safety record (including number of citations by OSHA, lawsuits due to safety violations), references from past jobs, change orders, history of past jobs, timely completion of past jobs, proposed personnel and financial stability.
