Response from City August 18, 2025, 3:00pm The City adopted an Ordinance amending Chapter 16 of the City Code regarding public works contracts and project labor agreements. For all public works projects estimated in excess of $50,000 where public funds will be expended, the City of Bloomington shall require a project labor agreement unless it has been determined that a project labor agreement would not advance the City's interest of cost, efficiency, quality, safety, timeliness, skilled labor force, and labor stability and the City's policy to advance minority-owned or female-owned business, or businesses utilizing minority and female workers. The terms of any project labor agreement shall not exceed the economic standards established by the Illinois Prevailing Wage Act, as form time to time amended, nor contain any requirement of union membership of any contractor's employees or fair share payment by contractor's employees. Project Labor agreement shall not be required for contracts for private development between the City and developers involving private business development activities (e.g., incentive agreement with developers on private development projects). Background The City of Bloomington, incorporated in 1856, is a home rule unit of government under the 1970 Illinois Constitution. The City of Bloomington is located in the heart of Central Illinois, approximately 125 miles southwest of Chicago, 155 miles northeast of St. Louis and 64 miles northeast of Springfield, the State Capital. The City of Bloomington is the County Seat of McLean County, the largest county in Illinois (approximately 762,240 acres). The results of the 2010 Census shows the City now has a population of 76,610 citizens. The economic strength of the City of Bloomington metropolitan area is well diversified with no single dominating industry. The City of Bloomington reserves the right to reject any and all bids and to waive technicalities. The City of Bloomington requires all Bidders/Consultants doing business with the City not to discriminate on the basis of race, age, color, religion, gender, ancestry, national origin, marital status, mental or physical disability unrelated to ability, familial status or sexual orientation. Bid must be accompanied by a Bid guaranty which shall not be less than ten percent (10%) of the amount of the Bid. Bid guaranty may be a cashier's check, money order, certified bank check, or a surety bond. All guaranties, except surety bonds, will be deposited and reimbursement checks and surety bonds will be issued to unsuccessful bidders following the bid award. The successful bidder will be required to provide Performance and Payment Bonds in the amount equal to 100% of the contract price, within ten (10) business days after the bid award. Contractors shall not pay less than the prevailing rates of wages to all laborers, workmen, and mechanics performing work under this contract, and shall comply with the requirements of the Illinois Prevailing Wage Act (820 ILCS 130/1-12) including Public Act 100-1177 effective June 1, 2019. Bids may not be withdrawn for a period of 90 days after the bid opening date. If the bidder will utilize subcontractors, 8% of the total contract amount should be awarded to MBEs, DBEs, and/or WBEs.
