Bids must be from appropriately licensed contractors, must be sealed, labeled and accompanied by money order, or bidder's bond from a surety company registered with the State of California Insurance Commissioner made payable to the City of Lodi in the sum of not less than ten percent (10%) of the amount of the bid. The money order or bonds shall be given as a guarantee that the successful bidder will enter into a written contract within ten (10) calendar days after being requested to do so and will be considered as the stipulated amount of liquidated damages in the event the bidder is unable to or refuses to execute a contract for the work. The Contractor agrees to commence work within 15 calendar days after both parties have signed the contract or the date stipulated in the Notice to Proceed and to complete the work within 180 CALENDAR DAYS. Upon signing the contract, Contractor agrees that length of time of the contract is reasonable. Per Senate Bill 854, contractors and listed subcontractors must be registered with the Department of Industrial Relations (DIR) prior to submitting bids to any public work contracts. Failure to comply will make bids non-responsive. No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with DIR pursuant to Labor Code Section 1725.5. In accordance with the provisions of Section 1770 of the Labor Code, the Director of Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension The Contractor and any subcontractor shall pay each employee engaged in the trade or occupation not less than the hourly wage rate. As the wage determination for each craft reflects an expiration date, it shall be the responsibility of the prime contractor and each subcontractor to ensure that the prevailing wage rates of concern are current and paid to the employee. The Contractor shall make travel and subsistence payments to each worker needed to execute the work as such travel and subsistence payments are defined in the applicable collective bargaining agreements in accordance with Section 1773.8 of the Labor Code. If a craft or classification used on the project is not shown on the wage determination, the Contractor may be required to pay the wage rate of that craft or classification most closely related to it as shown in the general determinations. The City of Lodi hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex or national origin in consideration for an award. The City of Lodi hereby notifies all bidders of the City's local hiring and apprenticeship ordinance to strongly encourage local hire and apprenticeship practices. The City requires that all bidders comply with the ordinance on projects that are estimated to exceed $200,000; and will reject bids that fail to demonstrate a good faith local hire effort. For any moneys earned by the Contractor and withheld by the City of Lodi to ensure the performance of the contract, the Contractor may, at Contractor's request and expense, substitute securities equivalent to the amount withheld in the form and manner and subject to the conditions provided in Section 22300 of the Public Contract Code of the State of California. The Contractor shall submit copies of payroll records. Bids shall be made upon the form provided by the Owner and shall be properly completed with all items filled out; numbers shall be in writing and figures; the signatures of all persons signing shall be in longhand. No bidder may withdraw his bid for a period of 60 calendar days after the time set for the opening of bids, and the City will act to accept or reject bids within that period of time. Upon the contractor's request, the Owner will make payment of funds withheld from progress payments pursuant to the requirements of Government Code Section 4590 if the contractor deposits in escrow with the Owner's Treasurer or with a bank acceptable to the Owner, securities eligible for the investment under Government Code Section 16430 or bank or savings and loan certificates of deposit, upon the following conditions: a. The contractor shall bear the expense of the Owner and the escrow agent; either the Owner's Treasurer or the bank, in connection with the escrow deposit made. b. Securities or certificates of deposit to be placed in escrow shall be of a value at least equivalent to the amount of retention to be paid to the contractor pursuant to this section. The City Council reserves the right to reject any or all bids and to waive any informality in the completion of such forms, and to award to the lowest responsible bidder.
