The City of Buffalo is soliciting proposals from experienced yard waste disposal operators to submit offers for the City of Buffalo's Yard Waste Disposal. Scope of Services It is the intent and purpose of the contract on which proposals are sought to assure the disposal of yard waste during the contract period of up to approximately 10,000 tons per year of yard waste. Yard Waste shall mean yard waste collected by or on behalf of the City of Buffalo ("City") and received at the Contractors and/or the City's facility that is composed of the following items: Plant cuttings, roots, grass, weeds and leaves. Hedge and shrub trimmings, brush cuttings, twigs and branches. Trees. Brush. Any other item designated as yard waste as reasonably determined by the Commissioner of Public Works. All material shall be either loose or in plastic bags or paper bags. The quantity identified in this proposal is not a guarantee by the City for delivery or generation. The sole purpose of supplying these volumes is strictly for the proposal evaluation and comparison to determine award. However, the Contractor must be prepared to accept the maximum amount of yard waste available from the City of Buffalo during the period beginning from the date of the contract and ending June 30, 2026. The City anticipates working with the selected proposer in two potential options as defined below. The City will have at least one site where the contractor, under Option 1, will be required to pick up yard waste collected by the City. Under Option 2, the Contractor will also be required to designate a site where the City crews will be able to direct-haulyard waste materials for drop off. Option 1. City Selected Site(s) - Contractor Collection/ Yard Waste Site The Contractor will be required to collect and process yard debris at a location within the City limits as determined by the Commissioner of Public Works, Parks and Steets ("Commissioner"). The City may require additional collection at two additional sites in the City during the fall season (leaf pick up and Christmas tree collection) at no additional charge to the City. The Contractor is required to collect yard waste at the City designated location within one week of being contacted by the City unless prior arrangements are made with the Commissioner, Yard waste will be loaded by city crews using a front-end loader into contractor-provided container(s). Yard waste will then be transported by the Contractor to the Contractors site. The Contractor will be required to submit weight slips with invoices. Option 2. Contractor Compost Site The City will also have the option of delivering yard waste to the Contractor's site. Contractor will provide a scale for City trucks to use or provide the City with a mutually agreed upon method for estimating tonnage. The Contractor will be required to submit weight slips with invoices. Finished wood chips and compost will be made available to City residents at no additional charge to the City or to the City's residents. Contractor will be required to allow access to the Contractor's facility by the community at times that are mutually agreed upon. The Contractor is responsible for compliance with all applicable laws and regulations promulgated by the New York State Department of Environmental Conservation ("NYSDEC") and Buffalo City Code. Proposers shall explain the end use for the yard waste The City contemplates entering into an agreement with the successful applicant for an initial term through June 30, 2026, with an option to renew for an additional four (4) but separate one year periods, to be exercised at the City's sole discretion. Under no circumstances will the City of Buffalo Department of Public Works, Parks and Streets consider a proposal which is received after the deadline. Question Deadline 08/25/2025 at 4:00 PM ET All questions concerning this request for proposal shall be submitted via email by to: jjacobs@buffalony.gov. All questions and answers will be posted online by 4:00pm September 1, 2025. The contract period is from the date of the contract through June 30, 2026. The contract may be extended for up to four (4) additional separate consecutive one (1) -year periods, to be exercised at the City's sole discretion and would run from July 1 - June 30 of subsequent years. The City shall also have the right to unilaterally terminate this Agreement, with or without cause, at any time with 10 days written notice. Liquidated Damages Under Option 1, if volume of yard waste stored at the City site remains on site after one week from the date of the request of the removal, City may impose liquidated damages in the amount of $500/day. Any proposals received after the time and date specified for opening will not be considered. Any proposals may be withdrawn prior to the scheduled time for the opening thereof. No offeror may withdraw his proposal within forty-five (45) days after the date of opening thereof. Proposals received after the time and date stated in the advertisement for proposals will not be accepted. Contract Award Any proposed contract award shall be subject to all required approvals. Contract award shall subject to comply with the following conditions, where applicable: Americans with Disabilities Act City of Buffalo Living Wage Ordinance as specified in Attachment B. The City reserves the right to postpone or cancel the RFP and to reject any or all proposals.
