The City of Rosenberg is seeking bids from qualified vendors for the following: Water Plant No. 2 - 1415 Alamo Street, Rosenberg, TX 77471 Removal of One (1) existing 350kw Diesel Generator and 600 Amp Automatic Transfer Switch and Pad Purchase and Turnkey Installation of One (1) Permanent 400kw Natural Gas Generator and 800 Amp Automatic Transfer Switch on new engineered concrete pad Water Plant No. 4 - 3720 Airport Road RR, Rosenberg, TX 77471 Removal of One (1) existing 350kw Diesel Generator and 600 Amp Automatic Transfer Switch, Pad and Weather Cover Structure Purchase and Turnkey Installation of One (1) Permanent 400kw Natural Gas Generator and 800 Amp Automatic Transfer Switch on a new engineered concrete pad These generators will mitigate the above locations from power loss due to natural hazards. The generators will be installed with an automatic transfer switch (as specified herein) on concrete pads as specified herein. The project will be in compliance with latest edition of codes and standards required by Federal, State and Local rules and regulations. Contractor shall be responsible for final connection to the gas meters. This is an acknowledgement that FEMA financial assistance will be used to fund all or a portion of the contract. The selected contractor will comply with all applicable federal law, regulations, executive orders, FEMA policies, procedures, wage documentation and directives. Such liquidated damages shall be computed with respect to each individual laborer or mechanic, including watchpersons and guards, employed in violation of the clause set forth in paragraph (b)(1) of this section, in the sum of $32 for each calendar day on which such individual was required or permitted to work in excess of the standard workweek of forty hours without payment of the overtime wages required by the clause set forth in paragraph The Contractor grants to the City of Rosenberg, a paid-up, royalty-free, nonexclusive, irrevocable, worldwide license in data first produced in the performance of this contract to reproduce, publish, or otherwise use, including prepare derivative works, distribute copies to the public, and perform publicly and display publicly such data. For data required by the contract but not first produced in the performance of this contract, the Contractor will identify such data and grant to the City of Rosenberg or acquires on its behalf a license of the same scope as for data first produced in the performance of this contract. Data, as used herein, shall include any work subject to copyright under 17 U.S.C. 102, for example, any written reports or literary works, software and/or source code, music, choreography, pictures or images, graphics, sculptures, videos, motion pictures or other audiovisual works, sound and/or video recordings, and architectural works. Upon or before the completion of this contract, the Contractor will deliver to the City of Rosenberg data first produced in the performance of this contract and data required by the contract but not first produced in the performance of this contract in formats acceptable by the City of Rosenberg. The City reserves the right to extend this period if it is in the best interest of the City. In the event the City exercises its right to terminate without cause, it is understood and agreed that only the amounts due to the Successful Bidder for goods, commodities and/or services provided, and expenses incurred to and including the date of termination, will be due and payable. No penalty will be assessed for the City's termination for convenience. The Recipient reserves the right to pursue any other legal remedies available under applicable federal, state, or local law.
