No bid will be entertained unless made on forms furnished by the Village Engineer or an exact copy thereof. Each bid must contain the name of every person interested in it, and must be accompanied by a Bid Bond, Certified or Cashier's Check, drawn upon a solvent bank, payable to the Village in an amount equal to 10% of the amount bid, as a guarantee that the bidder, if the award is made to him, will enter into a bonafide contract under the Specifications. If for any reason whatsoever the successful bidder fails to enter into a proper contract and to execute the Performance Bond as required by the Specifications, the amount of such guarantee shall be retained by the Village as and for liquidated damages sustained by reason of his failure to do so. The checks received from the unsuccessful bidders will be returned as soon as the contract is awarded, signed and performance bond furnished, or within ten (10) days from the scheduled closing time for receipt of bids, provided however, that the bid of the second lowest and best bidder may be retained until the successful bidder has entered into such contract. Should the successful bidder fail to enter into such contract within ten (10) days from the award, then the Council may award such contract to the second lowest and best bidder or reject same. No bid may be withdrawn for at least ten (10) days after the scheduled closing time for the receipt of bids. The Village reserves the right to accept or reject any or all bids. Pursuant to Glenwillow Codified Ordinance 107.14, the Village reservesthe right to consider all elements when determining the qualifications and responsibility of any bidder. The award of the contract, if it is awarded, will be to the lowest and best bidder whose proposal complies with all the requirements prescribed in Chapter 107 of the Glenwillow Codified Ordinances.
