Spring to spring Trail, Phase 3C: From High banks Rd to Debary Plantation Blvd. Question Submission Deadline: September 11, 2025, 11:59pm It is incumbent upon each bidder to carefully examine this solicitation's specifications, Scope of Work service, terms, and conditions. The posting of answers through at online. Questions and exceptions concerning any Section of this ITB shall be directed through the question and answer functionality of the County's eProcurement Portal. Questions and exceptions shall be submitted by the question and answer deadline. Thereafter, no further questions or exceptions will be accepted or reviewed by the County and bidders' right to submit questions or exceptions will terminate and any questions or exceptions not previously made shall be deemed waived. Oral representations will not be binding on the County. Term: Total contract time: 210 days. No pre-bid meeting will be held. It is the responsibility of the bidder to become familiar with the site. The County of Volusia, Public Works/Engineering and Construction is seeking a single, responsive and responsible bidder for the construction of Spring to Spring Trail, Phase 3C (High banks Road to DeBary Plantation Blvd, DeBary) located at High banks Road and Don Smith Boulevard in DeBary, Florida. The lowest responsive and responsible bidder shall be responsible for all applicable permitting, labor, materials, equipment, tools, transportation, services, and incidentals necessary to complete all Work required by the specifications and as shown on the drawings. In accordance with the American Disabilities Act and Section 286.26, Florida Statutes, persons with disabilities needing a special accommodation to participate in the proceedings, or an interpreter to participate in any proceedings, should contact the county's ADA Coordinator at 386-248-1760 for assistance, at least two business days before any meeting date. Assisted listening system receivers are available for the hearing impaired, and can be obtained from the Deputy Clerk by contacting the county's ADA Coordinator at 386-248-1760. Read the full ADA Notice under The American with Disabilities Act (Title II). Read the County of Volusia Grievance Procedure under The Americans with Disabilities Act (Title II). A Bid bond shall accompany each Bid in an amount not less than five percent (5%) of the Bid amount and shall be valid for a period not less than one hundred twenty (120) days. If a Bid bond is used, the Bidder shall complete and submit the Bid bond form provided in this solicitation. After the County and the successful bidder have executed a written Contract and the successful bidder has recorded an acceptable Payment and Performance Bond or if one hundred twenty (120) days have passed after the date of the formal opening of the Bids and no Contract has been awarded, the Bid security of any Bidder will be returned upon written demand. For the purpose of award, after the Bids are opened and read, the correct summation of the Lump Sum prices and/or of the products of the estimated quantities shown in the Bid and the unit prices will be considered the Bid. The amounts will then be compared and the results of such comparison made available to the public. Until the final award of the Contract, the right will be reserved to reject any and all bids and to waive technical errors and irregularities as may be deemed best for the interest of the County. Should the County require Payment and Performance Bond, the cost of such bonds shall be added to the Contract price for purpose of Contract award. The County reserves the right to reject any or all Bids, or any part of any Bid, to waive any informality in any Bid, or to re-advertise for all or part of the Work contemplated. The County reserves the right, prior to award of Contract, to delete from the scope of the project any item or any combination of items the aggregate Bid prices for which do not exceed twenty-five percent (25%) of the total Bid price for the project. If Bids are found to be acceptable by the County, written notice will be given to the lowest responsive and responsible bidder of the acceptance of his/her Bid and the award of a Contract. Liquidated Damages for Delay. All time periods stated in the Contract Documents are of the essence of the Contract. The County and Contractor agree that any damages and losses to the County which will result from the Contractor's failure to complete the Work within the time specified (including any extensions thereof approved by the County) are impossible to accurately determine at the time of executing this Contract. Such sums as detailed in Article 2.3 of the Construction Contract are hereby agreed to be reasonable predictions of damages, which will be sustained and are specifically declared to not constitute a penalty for breach of contract.
