The contractor is to supply and deliver an estimated 1,500 cubic yards annually of engineered wood fiber (EWF) safety surface to various playgrounds throughout the City of Visalia. Inspection and acceptance of materials or supplies shall be made after delivery. Please see Section IX, Special Conditions, relating to inspection. Final inspection shall be conclusive except as regards latent defects, fraud, or such gross mistakes as amount to fraud. Final inspection and acceptance or rejection of the materials or supplies shall be made as promptly as practicable, but failure to inspect and accept or reject materials or supplies shall not impose liability on the City for such materials or supplies as are not in accordance with the specifications. All delivered materials shall be accepted subject to inspection and physical count. The City reserves the right to reject any item or items in the Bid; to waive informalities, technical defects, and minor irregularities in Bids received; and to select the Bid(s) deemed most advantageous to the City.
