Bidders shall be licensed in accordance with Chapter 444, HRS, relating to the licensing of contractors. The Contractor and his Subcontractor(s), if any shall comply with all applicable revisions of the prevailing wage rate schedule as required under Chapter 104, H.R.S. No proposal will be considered unless accompanied by one of the following forms of bidder's security: cash, a cashier's check, or a certified check on a bank insured by the Federal Deposit Insurance Corporation, or a bidder's bond executed by an approved surety insurer, made payable to the Director of Finance in the manner, form, and amount required by Section 103D-323 of the Hawaii Revised Statutes. The proposal guaranty shall be equal to at least five percent (5%) of the total amount of the bid submitted. Bidders are required to comply with the newest procurement code, HRS, Chapter 103-D, any rules and regulations and policy directives issued with respect to Chapter 103-D and any amendments thereof. Contractors are hereby notified of the applicability of Section 11-205.5, HRS, which states that campaign contributions are prohibited from specified State or county government contractors during the term of the contract if the contractors are paid with funds appropriated by the legislative body. The County of Maui, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252) and the Regulations of the U.S. Department of Transportation (Title 49, Code of Federal Regulations Part 21) issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that the contract entered into pursuant to this advertisement will be awarded to the lowest responsible bidder without discrimination on the grounds of race, color, religion, sex, national origin, age, or disability.
