Sidewalks, trail, and wheelchair ramps shall comply with current Texas Department of Licensing and Regulation (TDLR) requirements. 3. Contractor will be responsible to provide plant protection in accordance with the plans and specifications. 4. Contractor will be responsible to implement the Storm Water Pollution Prevention Plan (SWPPP) for the GREENS BAYOU GREENWAY IMPROVEMENTS - SEGMENT GR03 - BUSINESS 90 TO BROCK PARK and use best practices during construction. Project construction activities will disturb an area greater than 5 acres. See Section 01410 - TPDES Requirements. Contractor shall be responsible for all fees, including notices, fillings and permits associated with SWPPP and TPDES requirements at no additional cost to HPB. The Cash Allowance for TPDES permits is limited to the application fee for the Notice of Intent for Storm Water Discharges Associated with Construction Activity under TPDES General Permit. 5. The Contractor will be responsible to obtain all necessary permits, including but not limited to: lane closures and street cut. Permits that are required and are not paid under Cash Allowances are incidental to all other pay items and are at no additional cost to HPB. 6. Contractor is to comply with O.S.H.A regulations and state of Texas law concerning excavation, trenching and shoring. 7. Contractor will be responsible to use caution and due diligence where the proposed improvements are in proximity to existing private or public utilities including gas lines, water lines, wastewater lines, buried or overhead cables, etc., so as to not adversely impact such utilities within the project area. Contractor will contact and coordinate with private utility agencies whose facilities may be impacted by the proposed improvements, as required. MWSBE Goal: 24% percent.
