Site work for a water / sewer project in Spring, Texas. Completed plans call for site work for a water / sewer project.

Work includes but is not limited to the construction of approximately 1,011 linear feet of 15" and 24" Sanitary Sewers, including construction of related manholes and relocation of approximately 22 linear feet of existing forcemain. All bids shall be accompanied by a Cashier's Check, (or Bid Bond for projects greater than, or equal to, $25,000.00) drawn on a bank authorized to do business in the State of Texas and acceptable to the OWNER, or a Bid Bond, in an amount equal to five percent (5%) of the total amount bid, as a guarantee that the successful bidder will enter into a Contract and execute Performance, Payment, and Maintenance Bonds within twenty-one (21) days after Notice of Award of Contract to him. The Notice of Award of Contract shall be given by the OWNER within sixty (60) days following the opening of bids. The surety on the Bid Bond must be duly authorized by the State Board of Insurance to do business in the State of Texas and to execute and issue Bid Bonds. The Bid Bond, if provided, must be executed by Principal of firm submitting bid and an Attorney-in-Fact of Surety Company residing in the State of Texas and licensed by the Texas State Board of Insurance to write Bid Bonds on behalf of the surety. Bid Securities and Bid Bonds will be returned to all but the three (3) lowest responsible bidders within ten (10) days after the opening of Bids. The bid security of the three (3) lowest responsible bidders will be returned within seven (7) days after execution of the Contract. The successful bidder must furnish Performance Bond, Payment Bond, and Maintenance Bond upon the forms which are attached hereto, as security for the faithful performance and payment of all his obligations under the Contract Documents. These Bonds shall be in the amount of one hundred percent (100%) of the Contract Amount. The surety for said bonds must be duly authorized by the Texas State Board of Insurance to do business in the State of Texas and to execute and issue Performance, Payment, and Maintenance Bonds, and must designate an agent resident in the county of the OWNER to whom any requisite notices shall be delivered and on whom service of process may be had in matters arising out of the suretyship. The bonds must be signed by a duly authorized representative of the surety who is licensed by the Texas State Board of Insurance to write bonds on behalf of the surety. The Contract shall not be in effect until such bonds have been provided by the Contractor and accepted by the OWNER. If any bond required hereby is in an amount in excess of ten percent (10%) of the surety's capital and surplus, the surety shall provide written certification to the OWNER that the surety company has reinsured that portion of the risk in excess of ten percent (10%) of the surety's capital and surplus with one or more reinsurers who are duly authorized, accredited, or trusteed to do business in the State of Texas and that the amount reinsured does not exceed ten percent (10%) of the reinsurer's capital and surplus. As used herein, the term "capital and surplus" shall mean the amount of allowed capital and surplus as of the date of the last annual statutory financial statement of the surety or reinsurer authorized and admitted to do business in the State of Texas. In conformance with applicable statutes, the general prevailing wage rates in the locality in which the work is to be performed have been ascertained, and such rates shall be the minimum paid for labor employed upon this project. In addition, the successful Bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, age, or national origin. The OWNER reserves the right to reject any or all bids and to waive informalities in bidding. In case of ambiguity or lack of clearness in stating the prices in any bid, the OWNER reserves the right to consider the most advantageous construction thereof, or to reject the bid. The award will be made to the responsible bidder submitting the lowest acceptable bid. The OWNER shall evaluate bids based on total cost, CONTRACTOR experience with OWNER, CONTRACTOR experience with other entities, equipment, and deliverability within the project time, AND deliverability of the completed work. The CONTRACT will be awarded to any responsible person or persons that, in the Board's judgement, will be most advantageous to the District and result in the best and most economical completion of the District's proposed plants, improvements, facilities, works, equipment, and appliances.
