The City intends to select a qualified provider for the development, implementation, and monitoring of a comprehensive infrastructure modernization and utility savings program. Upon award, the City will enter into a professional services agreement for a comprehensive City-wide site assessment. Prior to entering into a contractual agreement for project implementation, an agreed upon scope of work and project pricing will require separate board approval. The City intends to implement a design-build program consistent with the provisions of California Government Code sections 4217.10-4217.18 that will provide sustained efficiencies and energy cost savings. The City is issuing this Request for Proposals (RFP) from Energy Services Companies (ESCOs) to identify and, if agreed, deliver financially viable energy-cost saving projects for city facilities. The primary goals of this project are to investigate opportunities to develop a program to enable the City to strategically reinvest liabilities (energy and maintenance costs and flared methane) into sustainable facility and technology enhancements that will lead to stronger financial stability, streamlined operations, carbon reductions and, most importantly, operational improvements to optimize existing city assets. The program would leverage budgeted dollars to provide the highest level of service utilizing the ESCO delivery method, which is similar to a design-build delivery. After evaluating the responses to the RFP, the City may enter into an energy services contract and any necessarily related facility ground lease on terms that the City Council determines are in the best interests of the City, pursuant to Government Code Section 4217.12, or take any other procurement action, or no action. The City, at its sole discretion, may select the awarded respondent for subsequent phases of work. Qualified entities are invited to submit written proposals for consideration in accordance with this request. These services will be conducted under a contract with the City. The proposing entity is hereinafter referred to as "Contractor". The contract will be regulated according to the provisions of all State and local laws and ordinances that are applicable. The City is situated along the border with SR 98, about 120 miles east of San Diego, 60 miles west of Yuma, Arizona and adjacent to Mexicali, Baja California, Mexico. The City is the second largest city within Imperial County. The City encompasses approximately 8.4 square miles in size and has a population of approximately 41,000 people; however, during weekday working hours, its population temporarily increases due to visitors conducting city business or those working in the City, including many visitors from Mexico. Following an initial evaluation of each response to this RFP, the City may conduct interviews with ESCOs to discuss in detail the contents of their responses. However, the City is under no obligation to enter into discussions with any of the Responders. The City may then negotiate the services of an ESCO selected pursuant to Government Code Section 4217.10, et seq., or any other procurement method, to conduct an Investment Grade Audit, or IGA. The following sections describe the scope of work to be performed by the ESCO in the IGA. The ESCO is further expected, for agreed upon projects, to provide the design and construction services to perform the scope of work resulting in a complete project including drawings, specifications, equipment procurement, construction, and startup testing to provide a working system. In addition, all designs shall conform and adhere to industry best practices, applicable industry standards, and regulatory requirements. In the RFP response, the City invites each potential ESCO to respond fully with its capabilities with respect to each category below. The ESCO shall coordinate with the City all necessary measures, information, and site visits to prepare the IGA. Any requests for information, or other items, shall be submitted to the specified point of contact in a clear, orderly, and concise manner. To the extent consistent with applicable law, the City reserves the right to consider all audit information provided or produced as non-public information until various contract stages have occurred, such as the completion of an Energy Audit or the execution of an Energy Services Agreement with an ESCO. The RFP response should include particulars of timing and pricing for the IGA stage. As part of the IGA, the ESCO will prepare plans, specifications, probable construction costs, energy savings calculations, technical memorandums, and other design related documents sufficient to contractually implement savings and improvements as identified in the Energy Audit or as otherwise available. The project plans will describe the work and associated switch over and sequencing to maintain operation during construction. The project documents shall also describe the maintenance requirements necessary to ensure continued energy savings and provide incentive, rebate, grant, and other financing information for each measure identified that may be available to the City. All plans and specifications will be submitted for review to the City. It is important that the City's staff has input to and fully agrees upon the design, technology and operational intent; after which final, firm pricing and guaranteed savings will be presented at the conclusion at the IGA phase. The City shall have the option to reject any presented calculations of savings, potential savings allowed, or project recommendations. The ESCO will utilize site visits to gain knowledge and understanding of the project. Through regular progress meetings, the ESCO will develop and share with the City the scope of work, projected savings and costs. At the conclusion of the IGA, the City will have a shovel-ready deliverable with scope of work, drawings, a firm, fixed price construction agreement with documented energy, operational and maintenance savings. The selected respondent will then implement an agreed upon scope of work once approved by Council. All proposed infrastructure improvements must be provided on a turn-key basis including all necessary permits, engineering, delivery, installation, commissioning, training, warranty service, and compliance with any applicable funding programs. For projects accepted by the City, the ESCO will perform the construction and procure the equipment and materials as designed to provide a complete system as designed. In addition, the ESCO will provide construction support services, including as necessary for meetings, design clarifications, inspection of installation, review of change orders, and drafting for as-built record drawings. Following the construction phase, the ESCO shall monitor project savings, including but not limited to providing an energy savings guarantee following the International Performance Measurement and Verification Protocol (IPMVP). The City will be provided options for how it would like to see the savings reported in terms of frequency and format. The ESCO shall work with the City to provide a marketing plan that highlights the positive aspects of the project for press releases, community events and outreach. This will be developed in the IGA and implemented during the construction phase. Questions Due 3:00 PM November 05, 2025 The City, at its sole discretion, also reserves the right to reject any or all bidders. The City reserves the right to issue written notice to all participating contractors with any changes in the submission schedule, scope of work or work-related products, should it be determined that such changes are necessary.
