Bids must be submitted on Brushy Creek Municipal Utility District bid forms and must be accompanied by an acceptable bid security as outlined in the Instructions to Bidders, payable to the Brushy Creek Municipal Utility District, Texas equal to five percent (5%) of the total bid amount. In case of ambiguity, duplication, or obscurity in the bids, the Brushy Creek Municipal Utility District reserves the right to construe the meaning thereof. The Brushy Creek Municipal Utility District reserves the right to reject any or all bids, or to waive any informalities, or to make an award to other than the low bidder. The Brushy Creek Municipal Utility District also reserves the right to award any part or combination of parts of the project it deems necessary as well as any other rights established under the laws of the State of Texas. The successful bidder will be expected to execute the Brushy Creek Municipal Utility District's standard contract and to furnish performance and payment bonds, all as described in the bid documents.
