Furnish all labor, equipment, materials, supplies, and supervision necessary for the construction of proposed sidewalks as described in the plans and specifications. Bidders must inspect the site to inform themselves of all local conditions. The time for completion is 120 calendar days including Saturdays, Sundays, and legal holidays. Each bid must be accompanied by a certified or cashier's check or a bid bond in an amount not less than five percent (5%) of the total bid. The successful bidder will be required to furnish a Performance and Payment Bond, each for the contract amount, from a responsible surety company authorized to do business in Arkansas. Contractors must be licensed at the time the contract is signed. No bid may be withdrawn for at least 90 calendar days after the scheduled closing time for receipts of bids. The owner reserves the right to reject any or all bids, waive informalities, consider the most advantageous construction thereof, and award to the bidder(s) offering the proposal in the owner's best interest. Contract award may be denied without a properly completed Statement of Qualifications. All subcontractors must be acceptable to the owner. This contract is subject to Buy America, Build America provisions, applicable labor laws, non-discrimination provisions, wage rate laws, and other federal laws including the Fair Labor Standards Act of 1938, the Work Hours Act of 1962, and Title VI of the Civil Rights Act of 1964. Negotiations with contractors after the opening of bids and before contract award are strictly prohibited.
