Renovation of a mixed-use development in Scottville, Michigan. Completed plans call for the renovation of a educational facility; and swimming pool.
This project is contracted with Triangle Associates under a CM agreement whereby Triangle will act as the Owner's constructor. Triangle will hold all subcontract agreements. Specialty subcontractors are being solicited currently for the following: 088 - Glass and Glazing (Including Metal Panels) 097 - Hard Tile 130 - Special Construction Pool A. This Division includes all materials, labor, equipment, tools, supervision, permits, and incidentals necessary to complete installation and successfully test, start-up, and operate, in a practical and efficient manner, all mechanical systems indicated on the Mechanical Drawings and described in this Division. The work shall also include any items which, while not specifically included in the Contract Documents, are reasonable and are accepted trade practices or necessary for the proper completion of the systems. B. Mechanical systems in the contract shall include the following: 1. Plumbing systems including: a. Domestic potable hot water, cold water, sanitary drain, and storm drain sytems. b. Medical gas. c. Plumbing fixtures, piping, and insulation indicated in the Drawings and Specifications. d. Fire protection Specifications are covered in a separate specification provided by the Fire Protection Designer. 2. Heating, ventilation, and air-conditioning (HVAC) systems including all equipment ductwork, piping, insulation, and temperature control systems indicated in the Drawings and the Specifications. C. The General Provisions of this Contract, including General and Supplementary Conditions and other General Requirements specified in the Architectural, Electrical, Structural, and Fire Protection Specifications apply to the work specified in this Section. D. This section is not intended to supersede, but to clarify the definitions in Division 01, General Requirements. A. Work included in this Division consists of providing all demolition, labor, materials, equipment, tools, supervision, start-up services, Owner's instructions, including all incidental and related items necessary to complete installation, and successfully test, start up and operate building in a practical and efficient manner. Electrical Systems indicated on Drawings and described in each Section of Division 26 Specification and conforming with all Contract Documents. B. Work not included under this Division: 1. Low voltage temperature control wiring. Refer to Part 2, Paragraph 2.03 of this Section. 2. Field painting of equipment, except for repair to damaged factory finishes. C. The General Provisions of this Contract, including General and Supplementary Conditions and other General Requirements Sections, apply to the Work specified in this Section. D. This Section is not intended to supersede, but to clarify, the definitions in Division 1, General Requirements and Supplementary Conditions. E. The Contractor shall coordinate directly with the Owner and the General Contractor to complete the necessary documentation for eligible energy rebates from Consumers Energy as a result of this project. A. This section of the specification indicates the scope of the work for the West Shore Community College Pool Renovation contract. B. The Telephone, Television and Data Cabling raceway system shall include, but not be limited to, the following: 1. Complete raceway system including conduit as indicated on the drawings. 2. Provide all electrical power outlets as indicated on the drawings. 3. Installation of the raceway system shall be closely coordinated with the Contractor performing the wiring and termination of the Telephone, Television and Data Cabling systems. The electrical contractor for the West Shore Community College Pool Renovation Contract shall provide any miscellaneous power and raceway system work required to complete the raceway system to facilitate installation of the Telephone, Television and Data Cabling system. C. The Telephone, Television and Data Cabling System components will be provided under a separate contract. A. This section of the specification indicates the scope of the work for the West Shore Community College Pool Renovation contract. B. The Security Cabling raceway system shall include, but not be limited to, the following: 1. Complete raceway system including conduit as indicated on the drawings. 2. Provide all electrical power outlets as indicated on the drawings. 3. Installation of the raceway system shall be closely coordinated with the Contractor performing the wiring and termination of the Security Cabling systems. The electrical contractor for the West Shore Community College Pool Renovation Contract shall provide any miscellaneous power and raceway system work required to complete the raceway system to facilitate installation of the Security Cabling system. C. The Security Cabling System components will be provided under a separate contract. Subcontractor shall furnish qualified, competent and efficient labor, materials, equipment, tools, supervision, insurance, taxes, design and engineering (where applicable) and all other things or services necessary to fulfill all of these contract provisions and to professionally perform and timely complete the scope of Work for the Project in strict accordance with the Contract Documents as defined herein and as detailed on the Scope of Work Attachment A. The term "Work" means: (i) the furnishing and performance of all labor and materials by Subcontractor, at or for the benefit of the Project that is within the general scope of this Subcontract and the Contract Documents or that can be reasonably inferred by Triangle or the Owner from the general scope of this Subcontract or the Contract Documents; (ii) the general obligations applicable to all trade contractors in the general application provisions of the Contract Documents, (iii) unless specifically expressly excepted, the furnishing by Subcontractor of all permits, licenses, labor, material, equipment, supplies, plant, tools, scaffolding, hoisting, temporary facilities, transportation, superintendence, inspections and temporary construction of every nature; (iv) that which is to be produced and/or supplied pursuant to this Subcontract; and (v) the obligation of Subcontractor to visit the Project site, and to fully acquaint and familiarize itself with the Project site, surrounding and subsurface conditions and the character of the operations to be carried on at the site, and to make such investigations as Subcontractor may deem fit or as may be prudent for Subcontractor to fully understand the facilities, physical conditions and restrictions attending the Work. All Work shall be completed strictly in accordance with the requirements of this Subcontract and the Contract Documents. This Agreement, including any attachments or addenda, the contract between the Owner and Triangle, excepting the payment terms, any general and special conditions and requirements of the Project, the plans, specifications and addenda, insofar as they are applicable, all applicable federal, state or local laws and codes and the particular technical specifications relating to the Work of Subcontractor (all collectively called "Contract Documents") are incorporated herein by reference as a part of this Agreement. The Contract Documents are available for examination by Subcontractor at all reasonable times at Triangle's office. Subcontractor represents and agrees that it has carefully examined and understands the Contract Documents relevant to the Work; has familiarized itself with conditions affecting the difficulty of the Work; and has entered into this Subcontract based on its own examination, investigation and evaluation and not in reliance upon any opinions or representations of Triangle. The Contract Documents do not include any bids, proposals, letters or other communications of any kind relating to Work scope written or prepared by Subcontractor or at its direction. Subcontractor warrants and represents that it has completely and thoroughly reviewed the Contract Documents and the site and that it is satisfied as to the nature of the Work and all of its requirements under this Agreement. The Contract Documents as so incorporated constitute the final, complete and fully integrated agreement between the parties. Subcontractor shall be bound to Triangle to the same extent Triangle is bound to the Owner by all the provisions of said Contract Documents and shall strictly comply therewith in all respects. Subcontractor hereby assumes all duties, obligations, liabilities and responsibilities imposed upon Triangle in the Contract Documents relating in any way to the Work of Subcontractor. The Contract Documents shall be read together and interpreted consistently wherever possible. If Subcontractor observes, learns or discovers, or with reasonable diligence should have observed, learned or discovered any ambiguity or discrepancy in the Contract Documents or any code compliance issue, Subcontractor shall report said ambiguity, discrepancy or code compliance issue to Triangle immediately. In the event of an irreconcilable conflict, ambiguity or inconsistency in the Contract Documents, subject to section 1.2, said Contract Documents shall be interpreted in accordance with the following order of precedence; (1) this Agreement, (2) the plans and specifications, and what is on one shall be on both, (3) any general or special conditions, then (4) the prime contract between Triangle and the Owner. All design services furnished or provided by Subcontractor shall be procured from licensed independent design professionals. In all respects, Subcontractor and its design professionals shall comply with the occupational codes of the state where the Project is located.
