Frederick County intends to enter into a Unit Price Task Order with a qualified firm or firms to provide construction and construction-related services including but not limited to the construction, repair, retrofit, alteration and modernization for a variety of watershed restoration projects. Agreement Term: one year Questions concerning this solicitation must be addressed in writing and submitted to the OpenGov Procurement Portal by Tuesday, January 27, 2026 at 4:00 pm. Tentative Presentation/Interview Dates: March 16, 2026, and March 17, 2026 Scope of Work BACKGROUND Frederick County intends to enter into a Unit Price Task Order with a qualified firm to provide construction and construction-related services including but not limited to the construction, repair, retrofit, alteration and modernization for a variety of watershed restoration projects. The work involves the routine use of heavy equipment in the moving of earth, controlled placement of earth embankments, placement of rock in streams and outfalls, construction of pre-cast and cast-in-place concrete stormwater structures, and other associated tasks, most of which are defined in the Specifications. This Unit Price contract will allow the County to perform these projects according to their design but also allows for variations in field conditions at the time of construction, and the ability to address these projects in a timely, responsive manner. The Work will be performed in coordination with an Engineer's Technical Representative (ETR) with a fully permitted design. All work will involve the technical and contractual oversight of the Frederick County Division of Public Works, Division of Energy and Environment, or other Frederick County Divisions. The Contractor must provide the Work in accordance with all permits, and their requirements, provided by the Owner for the Projects in the Task Order; the permits are part of the Task Order Documents. The Contractor must obtain, and provide the Work in accordance with, all other permits required by law as necessary to complete the Work. The Contractor must schedule all required meetings and inspections with, and obtain required approvals from, the Regulatory Agencies administering each permit. The Work is not considered complete until the Frederick County Division of Planning and Permitting (DPP) Sediment Control Inspector has released the Sediment Control permit and the DPP Right-of-Way Inspector has released the Right-of-Way permit (as applicable). Additionally, the Contractor must obtain required approval signatures, as the inspections are completed, on any Construction Inspection Check-off List provided in the Task Order Documents. See Section 308 for additional Contractor responsibilities related to the Erosion and Sediment Control permit(s). The Contractor shall ensure the quality of work by employing qualified, experienced personnel, trained in environmental restoration and sediment control measures. The Contractor will provide all necessary management, supervision, personnel, labor, tools, materials, and equipment for each of the Unit Prices bid. This is the means of payment and is intended to be the price inclusive of all Contractor costs. SPECIFICATIONS/SCOPE OF WORK: NOTE: The specification sections are organized as per Bid Items listed in the Schedule of Unit Prices. Where applicable, items are cross-referenced to, and incorporate, information and requirements provided in the Part III - Technical Requirements of the Maryland State Highway Administration (MSHA) July 2025 Standard Specifications for Construction and Materials and the MSHA Book of Standards, latest revision. Note: Part I (General Provisions) and Part II (Terms and Conditions) of the MSHA Standard Specifications for Construction and Materials DO NOT APPLY to, and are not incorporated into, this Contract or Task Order. Refer to the terms and conditions of this Contract or Task Order including the General Conditions of Construction Contract. Any references in MSHA Part III - Technical Requirements to the "Administration" or "MSHA" shall be interpreted as referring to "Frederick County, Maryland." Any references in MSHA Part III - Technical Requirements to the "Engineer" shall be interpreted as referring to the "Contract Administrator" as defined in the Contract. Any references in MSHA Part III - Technical Requirements to the "MDE" shall be interpreted as referring to the "Frederick County Division of Planning and Permitting." However, any such changing shall not be to the exclusion of any required MDE reviews. Any references in MSHA Part III - Technical Requirements to material testing by the Engineer shall be deemed to be the Contractor's responsibility. Contractor must utilize the services of accredited material testing laboratories that are acceptable to the Contract Administrator. All field and laboratory testing required by the Contract must be performed by qualified professionals who are licensed to perform such tests. The results of all material tests must be submitted to the Contract Administrator promptly and before requesting payment for the Work being tested for compliance. Any reference to "Contract Documents" in the Specifications shall be interpreted as referring to "Task Order Documents and/or Contract (or Task Order) Documents." GENERAL NOTE: The referenced MSHA Sections and Subsections apply unless noted otherwise elsewhere in the Contract (or Task Order) Documents. In case of conflict between MSHA specifications and other Contract (or Task Order) Documents, the requirements of the other Contract (or Task Order) Documents shall apply. The Division 01 documents and general and supplementary conditions that are attached to this RFP will apply to all task orders. PRICE QUOTATIONS: To price work to be performed that is not included on the contract schedule of costs awarded by this solicitation, the Contractor shall provide a unit price (or lump sum) for any identified Special Provisions. If the Special Provision requires a subcontractor, the contractor shall obtain three quotations for each service or commodity required to complete the work. Quotations shall be obtained from reputable sources known to provide the highest quality goods/ services. Quotations shall list the type and number of craftsmen and/or laborers required to complete the Project. Itemized list and quantity of any materials to be reimbursed (e.g., specialty tools, equipment, etc.). No discrimination shall be utilized in the selection of a subcontracting firm. All responses to quotations shall be presented to the County as verification of pricing as well as authentication of the undertaking. The County may make suggestions as to the subcontractors chosen for each services as well as to the brand or type of goods being utilized in the completion of each project. The County reserves the right of ultimate approval of any subcontractor in the sole discretion of the County. For each subcontractor that the Contractor wishes to utilize, the Contractor shall: Name the subcontractor Provide the percentage of work the subcontractor is expected to perform Provide the dollar amount to be paid to the subcontractor Projects shall be invoiced to the County on the percentage of work completed (if the Task Order was a lump sum) or on a monthly basis (if the Task Order was a time and material).
