The project consists of the construction of a 12’ wide shared use trail. The "Build America, Buy America" requirements apply, specifically for all iron and steel products used in the project. Bids should be on a unit price basis. The bid proposal and the work of the proposed contract must comply with all applicable federal, state, county, and local laws, ordinances, and regulations. The contract is also subject to labor laws, non-discrimination provisions, wage rate laws, and other federal acts such as the Fair Labor Standards Act of 1938, the Work Hours Act of 1962, and Title VI of the Civil Rights Act of 1964. Each bid must be submitted on the prescribed form and accompanied by a certified check or bid bond payable to the City of Benton in an amount not less than 5 percent of the bid. All prime bidders must download bid documents from the designated online plan room to be included in the Plan Holders List and submit a bid; the receipt of addenda must be verified in the proposal. Registration and good standing in the System for Award Management (SAM) is required prior to contract execution. Bids containing material omissions or irregularities, or with obviously unbalanced unit prices, may be rejected. Bids may also be rejected if they fail to conform to bidding requirements and contract documents. The City of Benton reserves the right to waive irregularities, reject bids, choose the most qualified bidder, and postpone the contract award for up to 90 days from bid opening.
