The scope of work and services provided herein is intended to include a broad range of services and activities that may be performed over several years at METRO's discretion in order to meet its State of Good Repair objectives and plan for future growth. METRO will determine the work to be performed. There is no assurance that a particular item of work or project will be performed by the selected professional team. The following should be considered illustrative of the type, quantity and scale of work to be performed under this contract. Funding availability, Board approval and other factors may result in the addition or removal of anticipated services and projects from this scope of work. At a minimum, the scope of services will include the following projects. The potential projects to be delivered consist of: Design and Construction of new structures or additions onto current structures at 416 Kenmore Boulevard and the RKP Transit Center. Updates to METRO's Romig Road Transit Center. Design and Construction of Super Stops. Design and Construction of a Transit Oriented Development (TOD) project. Design and Construction of ADA-accessible concrete pads for transit amenities including bus shelters. Office space remodeling Sustainability Upgrades for existing facilities HVAC and various mechanical system upgrades Other miscellaneous design work as needed METRO reserves the right to reject any and/or all proposals, to re-advertise for proposals and to waive any informality in any proposal and to determine the most responsive proposal by its own criteria, as described within the specification. METRO further advises prospective Offerors that all proposals must be filed on the forms provided by the Authority, all required information in the Vendor Questionnaire section of this posting on OpenGov must be completed, and that all proposals must be in response. In the event that errors, omissions, inconsistencies, or lack of coordination in the A&E firm's drawings or specifications result in additional costs, delays, or rework, the A&E firm shall be liable for liquidated damages. Such liquidated damages shall include all reasonable and documented costs incurred by the Owner, including but not limited to redesign efforts, construction change orders, contractor delay or impact costs, extended construction administration, inspection services, and schedule impacts directly attributable to the deficiency. The parties agree that these liquidated damages represent a reasonable pre-estimate of the Owner's actual damages and are not a penalty, and shall be assessed without the necessity of proving actual damages, provided a direct causal link is established between the A&E firm's error or omission and the resulting impact.
