In accordance with Public Contract Code section 20111, each bid shall be accompanied by cash, a cashier's or certified check, or a bidder's bond executed by an admitted surety insurer, made payable to the District, in an amount not less than ten percent (10%) of the maximum amount of the bid. The bid security shall be given as a guarantee that the Bidder to whom the Contract is awarded will execute the Contract Documents and will provide the required payment and performance bonds and insurance certificates within ten (10) days after the notification of the award of the Contract. Question Deadline 02/27/2026 at 2:00 PM PT Any questions relative to the bid shall be in writing and directed to crodriguez@kitchell.com and rzavala@kitchell.com. These requests shall be submitted to the District by the date stated above in the Schedule of Events. A payment bond is required for a public works contract involving an expenditure in excess of twenty-five thousand dollars ($25,000.00). Separate payment and performance bonds, each in an amount equal to 100% of the total Contract amount, are required, and shall be provided to the District prior to execution of the Contract and shall be in the form set forth in the Contract Documents. All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety insurer as defined in California Code of Civil Procedure section 995.120. In accordance with Division of the State Architect (DSA) Bulletin BU 24-05, all bidders are hereby notified that the awarded contractor must develop and submit a Site Safety Plan (SSP) during the contract execution phase. The SSP shall be updated as necessary to reflect the final project conditions before submission to DSA. The failure to provide an SSP in accordance with BU 24-05 will result in rejection of the DSA Form 102-IC. Bidders should account for this requirement when preparing their bid submissions. No bid may be withdrawn for a period of sixty (60) days after the date set for the opening for bids, except as provided by Public Contract Code section 5100 et seq. The District reserves the right to reject any and all bids and to waive any informalities or irregularities in the bidding.
