The proposed improvement consists of P.C. concrete sidewalk removal and replacement, P.C. concrete driveway removal and replacement, combination concrete curb and gutter removal and replacement, and all appurtenant construction at various locations throughout the City. Proposals must be submitted on the forms provided. No proposals or bids will be issued after 12:00 Noon on the specified date before the bid opening. All proposals or bids must be accompanied by a Bid Bond, Cash, or Certified Check made payable to the City of Berwyn in the amount of not less than five percent (5%) of the total amount of the Proposal as a guarantee that if the Proposal is accepted, a Contract will be entered into and the performance of the Contract properly secured. No bid shall be withdrawn after the opening without the consent of the Mayor and City Council for a period of forty-five (45) days after the scheduled time of closing bids. The bidder is advised that the City is a recipient of a grant under the Housing and Community Development Act of 1974. The total cost of the project is funded with federal dollars. All laborers and mechanics must be paid wages at rates not less than those prevailing as determined by the Secretary of Labor and must comply with federal labor standards including the Davis-Bacon Act, Contract Work Hours and Safety Standards Act, and the Copeland "Anti-Kickback Act". Compliance with Equal Employment Opportunity and "Section 3" requirements, which require affirmative action to hire lower income residents and subcontract with local small businesses, is required. A Performance Bond equal to one hundred percent (100%) of the bid is required from the successful bidder. The contractor must provide sufficient insurance or guaranty of indemnity against claims for damages due to negligence during construction until acceptance as complete by the City.
